Ord 294ORDINANCE NO. 294 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA CHANGING THE ZONING CLASSIFICATION OF CERTAIN PROPERTY ZONE CHANGE APPLICATION (ZC 89-02A) WHEREAS, on June 13, 1989, the City Council of the City of Poway adopted a resolution approving General Plan Amendment application GPA 89-02A, amending the Land Use Element Plan of the Poway General Plan for Assessor's Parcel Number 314-480-11, located at the southeast corner of the intersection of Poway Road and Community Road and consisting of approximately 35.06 acres; and WHEREAS, the subject parcel's land use designations were amended from Community Commercial, and Residential Mobile Home Park (8 du/net acre) to Community Commercial for that area of the parcel located on the north side of Poway Creek; and from Residential Single-Family I (1 du/net acre) to Residential Mobile Home Park (8 du/net acre) for the remaining area of the parcel located on the south side of Poway Creek: and WHEREAS, the City Council finds that the zoning classification of the sub- ject Assessor's parcel should also be changed to maintain consistency with the General Plan as required by Section 56860 of the California Government Code; and WHEREAS, on June 13, 1989, the City of Poway held a properly noticed public hearing in accordance with the California Government Code and the California Environmental Quality Act to consider the Final Environmental Impact Report (EIR) prepared for the Haley Trust Properties Project, and said project involves General Plan Amendment 89-02A and companion Zone Change 89-02A; and WHEREAS, pursuant to recently enacted State legislation (AB 3180), a Mitigation Monitoring/Reporting Program has been prepared to ensure the success- ful implementation of all mitigation measures identified in the Final EIR, and said program is contained in the Final EIR; and WHEREAS, at said public hearing, the City Council adopted a resolution cer- tifying that: The subject Final EIR for the project application has been prepared and completed in compliance with the California Environmental Quality Act and the City of Poway Procedures for Implementing CEQA; and The subject Final EIR for the project application was presented to the City Council who reviewed and considered the information contained in that document including the response to public comments, and considered all testimony received at the public hearing prior to approving the project application. Ordinance No. 294 Page 2 e The City Council finds that the subject environmental document is complete and adequately addresses the environmental impacts of the pro- posed General Plan Amendment 89-02A and Zone Change 89-02A applica- tions. NOW, THEREFORE, BE IT ORDAINED that the City Council does hereby amend the City of Poway Zoning Development Plan for the subject Assessor's parcel from Community Commercial (CC zone) and Residential Mobile Home Park (8 du/net acre), MHP zone, to Community Commercial (CC zone) for that area of the parcel located on the north side of Poway Creek, and from Residential Single-Family i (1 du/net acre) to Residential Mobile Home Park (8 du/net acre) MHP zone for the remaining area of the parcel located on the south side of Poway Creek. EFFECTIVE DATE: This ordinance shall take effect and be in force thirty (3) days after the date of its passage; and before the expiration of fifteen (15) days after its passage, it shall be published once with the names and members voting for and against the same in the Poway News Chieftain, a newspapaer of general circulation published in the City of Poway.
