AN ORDINANCE OF THE CITY OF POWAY, CALIFORNIA
AMENDING SECTION 17.10.080.28
OF THE POWAY MUNICIPAL CODE
TO ALLOW GASOLINE SERVICE STATIONS
WHICH PROVIDE MECHANICAL SERVICE
TO LOCATE IN THE COMMERCIAL COMMUNITY (CC) ZONE
IF PERMITTED BY CONDITIONAL USE PERMIT
(ZOA 89-08)
WHEREAS, the City Council periodically finds it necessary to
amend Title 17 (Zoning Development Code) of its Municipal Code to
respond to changing conditions in the City; and
WHEREAS, the City Council wishes to encourage gasoline service
stations to continue to provide mechanical service; and
WHEREAS, a properly noticed public hearing was conducted in
accordance with Section 65853, et seq., of the California
Government Code and California Environmental Quality Act (CEQA) to
consider this ordinance; and
WHEREAS, the City Council finds that the proposed ordinance
would not result in significant adverse impacts and hereby issues
a Negative Declaration.
NOW, THEREFORE, BE IT ORDAINED that the City Council does
hereby adopt the following amendment as part of Title 17 (Zoning
Development Code) of the Poway Municipal Code.
Section 1:
Section 17.10.080.28 is amended to read as follows with the
underlining to indicate additions and strikeout to indicate
deletions to the text:

EFFECTIVE DATE: This ordinance shall take effect and be in
force thirty (30) days after the date of its passage; and
before the expiration of fifteen (15) days after its passage,
it shall be published once with the names and members voting
for and against the same in the Poway News Chieftain, a
newspaper of general circulation published in the city of
Poway.
Introduced and first read at a regular meeting of the City
Council of the City of Poway held the 12th day of September, 1989
and thereafter PASSED and ADOPTED at a regular meeting of said City
Council held the 26th day of September , 1989 by the
following roll call vote:
