RESOLUTION OF THE CITY COUNCIL AMENDING THE
PRIOR DETERMINATION OF UNPAID ASSESSMENTS
WHEREAS, the CITY COUNCIL of the CITY OF POWAY, CALIFORNIA, has heretofore under-
taken proceedings under the "Municipal Improvement Act of 1913", being Division ]2 of
the Streets and Highways Code of the State of California, and has confirmed assess-
ments upon the district described in its Resolution of Intention previously adopted
for the construction of certain public improvements in a special assessment district
known and designated as
ASSESSMENT DISTRICT NO. 79-]
(hereinafter referred to as the "Assessment District"); and,
WHEREAS, the previously approved list of unpaid assessments contained an error
whereby a cash payment was credited as full payment against Assessment No. 13-]
rather than against Assessment No. 13-2, as intended, both parcels being owned by the
same party; and,
WHEREAS, the City Council desires to correct said list of unpaid assessments to
reflect the intention of the property owner; and,
WHEREAS, said list of unpaid assessments has been amended and is on file in the
Office of the City Treasurer, and is now a true and accurate statement thereof.
NOW, THEREFORE, IT IS HEREBY RESOLVED AS FOLLOWS:
SECTION 1. That the above recitals are all true and correct.

That the assessments in said unpaid list which now remain unpaid, and the
aggregate thereof, are as shown on said list, as amended, as on file in
the Office of the Treasurer, and by reference made a part hereof.
That the records of the Treasurer be revised and amended in accordance
with the amended unpaid list now on file, to reflect a transfer of the
assessment lien agJinst Assessment No. 13-2 to Assessment No. 13-1, said
transfer to be based on the amount of payment made during the cash
collection period and resulting in the full discharge of the confirmed
assessment against Assessment No. 13-2, and the partial discharge against
Assessment No. 13-1.
