A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
ESTABLISHING MINISTERIAL PERMIT FEES FOR STRUCTURES
REGULATED BY NEW STATE MANDATED HANDICAPPED ACCESSIBILITY REGULATIONS
WHEREAS, the State of California has mandated the City to
commence enforcement on July 1, 1982 of the new handicapped accessibility
regulations;
WHEREAS, it is the intent of the City Council to establish fees
reflecting the full cost of enforcing building regulations;
WHEREAS, Section 51.212 et seq. of the City Code authorizes the
City Council to establish fees for various building construction permit
applications by resolution;
WHEREAS, the fee committee of the San Diego Chapter of the
International Conference of Building Officials has estimated the costs for
enforcing the new regulations and recommended that the building permit and
plan check fees be raised 13 percent for structures regulated by the new
State handicapped access laws; and
WHEREAS, the Construction Industry Federation has recommended
that any new fees not exceed one-half of the fees recommended by the fee
committee of the San Diego Chaper of the International Conference of
Building Officials.
NOW, THEREFORE, BE IT RESOLVED that the intent of the City
Council of the City of Poway, California does hereby establish the
following policy to regulate the above mentioned fees:
City prescribed building permit and plan check fees shall be
increased effective this date, by 6.5 percent for those
structures regulated by the new State handicapped access
regulations (California Administrative Code Title 24, Part 2).
APPROVED and ADOPTED by the City Council of the City of Poway,
State of California, this 10th day of August, 1982.
