A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
URGING THE LEAGUE OF CALIFORNIA CITIES
TO DEVELOP A STRONGER METHOD FOR THE
ENFORCEMENT OF THE INTENT OF SB 90
TO REQUIRE THE STATE TO PAY ALL EXPENSES OF
PROGRAMS MANDATED FOR IMPLEMENTATION BY CITIES
The City Council of the City of Poway does hereby resolve as follows:
WHEREAS, the cities of the State of California believed that SB 90 would
provide a sound vehicle for relieving the cities from the ever increasing and
almost impossible burden of financing programs mandated by the State of
California; and
WHEREAS, experience has shown that except for those instances where the
Legislature explicitly recognizes that they are mandating a program and concur-
rently acknowledges the financing of special programs, that the cities are in no
way relieved from a multiplicity of costly programs which they become obligated
to undertake as a result of actions of the State Legislature; and
WHEREAS, either through indirect or subsequent judicial actions, cities are
required, to bear the burden of programs established by the State.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Poway
urge the League of California Cities to secure legislation that would in every
instance require the State to pay for the costs of any program either directly
mandated or ultimately to be implemented by the cities.
PASSED, ADOPTED and APPROVED by the City Council of the City of Poway,
California, at a regular meeting thereof this 24th day of August, 1982.
