A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
ESTABLISHING GUIDELINES FOR THE IMPLEMENTATION
OF NEW STATE MANDATED PHYSICALLY HANDICAPPED ACCESSIBILITY REGULATIONS
WHEREAS, the State of California has mandated the City to
commence enforcement on July 1, 1982, of the new physically handicapped
accessibility regulations; and
WHEREAS, the complexity of the new regulations necessitate the
adoption of guidelines and procedures for implementation purposes.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City
of Poway, California, does hereby establish the following guidelines for
enforcement of the above mentioned regulations:
The City Engineer shall be responsible for the enforcement
of handicapped access standards applicable to all
improvements within the City right-of-way.

The City Planning Director shall be responsible for the
enforcement of handicapped access requirements for site
development when reviewed under a discretionary application.
The City Building Official shall be responsible for the
enforcement of handicapped access requirements within
buildings for which building permits are required.
The City Council shall serve as the appeals board to hear
appeals of staff interpretations of the regulations and
staff determinations of equivalent facilitation and
unreasonable hardship in accordance with the
Administrative Appeal Procedure, Section 7200 et seq. of the
City Zoning Ordinance.

City staff shall utilize the State architect's "Training
Seminar Workbook" for handicapped access enforcement
guidelines.

Findings of unreasonable hardship shall be documented and
maintained with the City approved plans for the project
(City form HA-l).

City staff shall follow City approved guidelines for
applying the regulations remodels, additions and tenant
improvements (City form HA-2).

City staff shall utilize the approved plan check list to
insure that all pertinent handicapped access requirements
are detailed on the plans to avoid unnecessary delays during
construction and possible costly remedial work (City form HA-
3).
City staff shall utilize the approved public information
sheet to assist the public in complying with the new
regulations (City form HA-4).
The City Building Official shall participate with the San
Diego County Chapter of the International Conference of
Building Officials (ICBO) to foster uniform and reasonable
enforcement of the new handicapped access regulations.
The City Building Official shall rely on the office of the
State Architect and the City Attorney for legal opinions
regarding handicapped access regulations.
APPROVED and ADOPTED by the City Council of the City of Poway,
State of California, this 14th day of September, 1982.
