P -10 -33 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING CONDITIONAL USE PERMIT 10 -20 ARBOLITOS SPORTS FIELD RENOVATION AND LIGHTS APN: 314 - 040 -24 WHEREAS, a renovation of the existing recreation fields, and the addition of lighting consisting of eight 70- foot -high poles with shielded lights, is proposed at Arbolitos Sports Field, located on the east side of Pomerado Road, south of Ted Williams parkway, in the Open Space- Recreation zone; and WHEREAS, on October 19, 2010, the City Council held a duly advertised public hearing to solicit comments from the public, both pro and con, relative to this application. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Poway, as follows: Section 1: The City Council has considered the Environmental Initial Study (EIS) and Negative Declaration (ND) for the project. The subject EIS and ND documentation are fully incorporated herein by this reference. The City Council finds, on the basis of the whole record before it, that there is no substantial evidence the project will have a significant impact on the environment and that the ND reflects the independent judgment and analysis of the City. The City Council hereby approves the ND. Section 2: The findings, in accordance with Section 17.48.070 of the Poway Municipal Code for CUP 10 -20, are made as follows: A. The location, size, design, and operating characteristics of the park, after renovation and the addition of field lights, are in accord with the title and purpose of Chapter 17.48 of the Poway Municipal Code (Conditional Use Permit Regulations), the Open Space- Recreation zone, the City General Plan, and the development policies and standards of the City in that: (1) public parks with lighted recreation fields are allowed with a Conditional Use Permit in the OS -R zone; and (2) the General Plan stated Policy is to maximize the usage of all park facilities through the centralized scheduling and extended use hours where feasible to meet community needs, and to evaluate park sites on an individual basis for the inclusion of sports lighting. B. The location, size, design, and operating characteristics of the park, after renovation and with the addition of lights, is compatible with and will not adversely affect or be materially detrimental to adjacent uses, residents, buildings, structures, or natural resources. The site is a developed recreation park within a suburban area that is close to being built out. The nearest residential uses are more than 500 feet from the field, and are further buffered from the field by changes in topography and intervening existing, mature landscaping. The CUP includes special operational restrictions, including limitations on the hours of operation and the use of amplified sound, to minimize disruption to nearby residential uses. Other nearby uses are commercial and institutional and will not be disrupted by evening recreation activity. Resolution No. P -10 -33 Page 2 C. The project is in harmony in scale, bulk, coverage, and density, and is consistent with adjacent uses. The project will result in the lighting of an existing recreation field and the extension of recreation activity into the evening hours. The CUP includes a stipulation that no more than one game can be played at one time in the evening to minimize disruption to the nearest residential uses that are more than 500 feet away. Given the small scale of the project (i.e., one game at one time being played in the evening vs. multiple games being played simultaneously) it is consistent with adjacent uses. Other than eight light poles and a new electrical transformer, no new structures are proposed, so development bulk and coverage will be minimal. D. There are public facilities, services and utilities available to the site. E. The proposed lights at the existing park will not have any harmful effect on desirable neighborhood characteristics. Arbolitos Sports Field is located within a primarily residential neighborhood and bordered on two sides by major arterial streets. To minimize impacts to the neighborhood, the CUP requires that lights be turned off at 9:00 p.m., stipulates that only one game can be played at one time, and prohibits the use of amplified sound and other noisemaking devices, except that coaches and referees can use whistles. The nearest residential uses are more than 500 feet from the field, and are further buffered from the field by changes in topography and intervening existing, mature landscaping. F. The City Traffic Engineer has determined that the generation of additional vehicle trips will not adversely impact the capacity and physical character of surrounding streets and /or the Circulation Element of the General Plan in that the transportation system has been designed to accommodate increased volume. G. The site is suitable for the type and intensity of the development in that the Arbolitos Sports Field is existing and the CUP merely renovates the fields and adds lights for evening recreational activities. The CUP requires that lights be turned off at 9:00 p.m., stipulates that only one game can be played at one time, and prohibits the use of amplified sound and other noisemaking devices, except that coaches and referees can use whistles. H. There will not be significant harmful effects upon environmental quality and natural resources. The project involves the renovation of existing sports fields and the addition of lights, which will all occur within a developed area. No natural habitat will be removed as a result of the project. Some natural habitat exists adjacent to the site to the east and north within a preserved open space area. This open space area was established prior to the City's adoption of the Poway Subarea Habitat Conservation Plan (HCP). The area is not within the Mitigation Area of the HCP, which is where habitat preservation efforts are currently directed. This open space area is bisected by public trails and contains a "mini" park /children's play area. It contains non - native vegetation and has been impacted over the years by edge effects (i.e., noise, lights, etc.) associated with the adjacent major Resolution No. P -10 -33 Page 3 roadways, the proximity of commercial, residential, and institutional development, and by periodic vegetation clearing for fire fuel management. Accordingly, the addition of lights, which will be shut off at 9:00 p.m., will have a less than significant effect on any biological resources. I. There are no other relevant negative impacts of the proposed use that cannot be mitigated in that the CUP requires that lights be turned off at 9:00 p.m., stipulates that only one game can be played at one time, and prohibits the use of amplified sound and other noisemaking devices, except that coaches and referees can use whistles. J. The impacts, as described above, and the proposed location, size, design, and operating characteristics of the proposed use, and the conditions under which it would be operated or maintained, will not be detrimental to the public health, safety or welfare, or materially injurious to properties or improvements in the vicinity nor be contrary to the adopted General Plan. The CUP requires that lights be turned off at 9:00 p.m., stipulates that only one game can be played at one time, and prohibits the use of amplified sound and other noisemaking devices, except that coaches and referees can use whistles. K. The proposed conditional use will comply with each of the applicable provisions of Section 17.48.070 of the Poway Municipal Code with regard to current development standards. Section 4: The City Council hereby approves CUP 10 -20, a renovation of the existing recreation fields, and the addition of lighting consisting of eight 70- foot -high poles with shielded lights, at Arbolitos Sports Field located on the east side of Pomerado Road, south of Ted Williams Parkway, in the Open Space- Recreation zone, subject to the following conditions: 1. Recreation field lighting shall be turned off at 8:00 p.m. 2. No more than one organized game shall be played at any one time when field lights are on. 3. The use of amplified sound, and other noisemaking devices, is prohibited. This does not include the use of whistles by coaches and referees. 4. Recreation field lighting shall be programmed by the Community Services Department on a case by case basis for the particular scheduled recreation activity to provide the minimum lighting level necessary to ensure user safety. Section 5 : The approval of CUP 10 -20 shall expire on October 19, 2012, at 5:00 p.m. unless, prior to that time, a Building Permit has been issued in reliance on the CUP approval and construction has commenced prior to its expiration.
