Ord 305ORDINANCE NO. 305 AN ORDINANCE OF THE CITY OF POWAY, CALIFORNIA REPLACING CHAPTER 15.24 OF THE POWAY MUNICIPAL CODE, WHICH ADOPTS THE UNIFORM FIRE CODE~ 1988 EDITION WITH CERTAIN AMENDMENTS, THE UNIFORM FiRE CODE STANDARDS, 1988 EDITION~ THE UNIFO~%~ FIRE CODE, 1989 SUPPLEMENT, AND THE NATIONAL FIRE PROTECTION ASSOCIATION STANDARDS 13, 13--D AND 13-R, 1989 EDITIONS WHEREAS, in August 1984, the City of Poway adopted Ordinance No. 131 to provide nationally recognized standards for the safe- guarding of life and property; and WHEREAS, the Government Code provide authority for reference of codes~ or portions of codes, and Sections 50022.1 through 50022.10~ inclusive, of the adoption by WHEREAS~ the City of Poway conducted an initial study and determined that the adoption of ordinance would not cause any significant adverse impacts; and environmental the proposed environmental WHEREAS, the City Council finds that the modifications and changes to the Uniform Codes are reasonably necessary because of the following local climatic~ geological~ and topographical conditions: 1. The City is situated in hilly~ inland terrain. Approximately 50% is "wildland" for fire purposes, covered by native vegetation on steep and frequently inaccessible hillsides. The native ground cover is highly combustible grasses~ dense brush and ch~pparal. Natural fire breaks in these areas are insignificant. 2. Our climate is warm and dry. The winds prevail from the west. However, seasonal strong dry east winds are variable in duration and intensity. These winds can significantly enlarge a wildland fire as well as cause abrupt and unpredictable changes in fire direction. Temperatures ranging between 75 and 100 F are common throughout the year. 3. The potential for fire damage is great in the wildland area~ as such, a fire can spread rapidly and response time can be slowed by difficult terrain and explosive vegetation. 4. Our rural road system includes narrow~ winding roadways~ often with grades in excess of that necessary for optimal response time for large fire apparatus. An additional factor affecting response time is the distance between the two fire stations and the fire location. 5. The rural water supply is limited, making it necessary for fire apparatus to travel time-consuming distances to obtain additional water once their initial water has been utilized. IV. VIOLATION--PENALTY 15.24.410 Violation---Penalty. I. GENERAL PROVISIONS AND ADMINISTRATION 15.24.010 Uniform Fire Code--Adoption. There is hereby adopted by the City Council~ City of Poway~ San Diego County, State of California~ for the purpose of prescribing regulations governing conditions hazardous to life and property from fire or explosion~ that certain Codes and Standards known as the Uniform Fire Code, published by the Western Fire Chiefs Association and the International Conference of Building Officials, being particularly the 1988 Edition thereof and including Appendix Chapters I--A; through V-~A inclusive, except III-A and III~-B, the Ordinance No. 305 Page 4 15.24.020 - 15.24.040 Uniform Fire Code Standards, 1988 edition, Uniform Fire Code, 1989 supplement, and the National Fire Protection Association Standards 13, 13-D, and 13-R, 1989 Edition, save and except portions as are hereinafter deleted, modified or amended by Sections 15.24.050 through 15.24.440 of this ordinance. Not less than three (3) copies of these Codes and Standards have been and are now filed in the office of the City Clerk and the same are hereby adopted and incorporated as fully as if set out at length herein, and from the date on which this ordinance shall take effect, the provision thereof shall be controlling within the limits of the City of Poway. A. Permits as required under this Code shall be renewable each year; B. Where no specific standards or requirements are specified in the City of Poway Uniform Fire Code, The Fire Prevention Bureau shall refer to, and use, the most recent edition of the National Fire Codes, as published by the National Fire Protection Association. 15.24.020 Establishment and duties of Bureau of Fire Prevention. A. The Uniform Fire Code shall be enforced by the bureau of fire prevention in the Department of Safety Services of the City which is established and which shall be operated under the supervision of the Director of Safety Services. B. The Fire Marshal in charge of the bureau of fire prevention shall be appointed by the Director of Safety Services on the basis of examination to determine his qualifications. C. The Director of Safety Services may detail such members of the fire department as inspectors as shall from time to time be necessary. The Director of Safety Services shall recommend to the City Manager the employment of technical inspectors, who, when such authorization is made, shall be selected through an examination to determine their fitness for the position. 15.24.030 Definitions. A. Wherever the word "jurisdiction" is used in the Uniform Fire Code, it is the City of Poway, Department of Safety Services. B. Wherever the words "Chief" or "Chief of the Fire Department" are used they shall be held to mean "Director of Safety ServiceS." C. Wherever the words "Chief of the Bureau of Fire Prevention" are used they shall be held to mean "Fire Marshal." 15.24.040 Appeals. A. Whenever the Chief disapproves an application or refuses to grant a permit applied for, or when it is claimed that the provision of the Code do not apply or that the true intent and meaning of the Code have been misconstrued or wrongly interpreted, the applicant may appeal from the decision of the Chief to the City Manager by filing with the City Clerk a statement addressed to the City Manager setting forth the facts and circumstances regarding the action of the Chief. The City Ordinance No. 305 Page 5 15.24.050 - 15.24.070 Clerk shall notify the appellant in writing of the time and place set for hearing of the appeal. The City Manager or designated representative, ten days from the date on which such appeal has been filed with the City Clerk, shall hear the appellant and the Chief and shall consider all relevant evidence and shall determine the merits of the appeal. The City Manager may affirm, overrule or modify the decision of the Chief, and that decision shall be final. B. The right to appeal to the City Manager from an action of the Director of Safety Services shall terminate fifteen days following the deposit of a certified letter in any branch of the United States Post Office addressed to the appellant at his/her above mentioned mailing address or personal service of said letter, advising the appellant of the order of suspension. ii. AMENDMENTS TO UNIFORM FIRE CODE 15.24.050 Section 2.101 added--Responsibility for enforce- ment. Section 2.101 is added to the Uniform Fire Code to read as follows: Building Official will not issue a certificate of occupancy without Fire Department approval. 15.24.060 Section 2.107 amended-~-Riqht of entry. Section 2.107 of the Uniform Fire Code is amended by adding the words "or refuse," to paragraph three~ sentence two, after the word "neglect," 15.24.070 Section 2.206 of Article 2, Division II added--- Cost recovery~ Section 2.206 of the Uniform Fire Code is added to read as follows: Cost Recovery for Fire Suppression, Emergency Services and Code Enforcement~ Medical A. Purpose. The purpose of this section is to obtain reimbursement from responsible individuals for the expenses of any emergency response by the City of Poway to protect the public from fire or hazardous substances. B. Reimbursement Required: In accordance with the Health and Safety Code Section 13000 et seq., an individual who acts negligently or in violation of the law and thereby requires the City of Poway to provide an emergency response to a danger posed by a fire or hazardous substance shall reimburse the City for the costs incurred. Standby and clean-up fees shall be established by resolution of the City Council. Ordinance No. 305 Page 6 15.24.080 - 15.24.110 15.24.080 Section 2.303 deletion and replacement--Board of A~3peals. Section 2.303 of the Uniform Fire Code is deleted entirely~ setting forth the City Manager and City Council as the Board of Appeals, as codified in Section 15.24.040 of this chapter. 15.24.090 Section 4.101 deletion and replacement--Permit ~cquisition. Section 4.101 of the Uniform Fire Code is amended by deletion of the last sentence and replacement with: Permits as required by the Chief and/or Fire Marshal are obtained from the bureau of fire prevention. An application and a fee approved by the Chief shall be required for such permit. Such permit fees shall be established by resolution of the City Council. 15.24.100 Section 4.108 amended--.Permits required. Section 4.108 of the Uniform Fire Code is amended by the addition of subsections A-4~ C-8~ and L--3 to read as follows~ A-4 Asphalt Kettles. To operate an asphalt kettle within the jurisdiction. C-o8 Christmas Tree Lots. To operate a Christmas Tree lot with or without flameproofing services. L-3 Liquid Petroleum Gas Dispensing. To operate an LPG dispensing operation, whether private or open to the public. 15.24.110 Article 9 amended .... Definitions. Article 9 of the Uniform Fire Code is amended to add the following definitions~ "Life Safety" sprinkler system shall meet NFPA Standards 13-D or 13-Rf as appropriate. "Property protection" sprinkler system shall meet Building Code Standard 38.1. Uniform 15.20.120 Section 10.207 (m) added--Fire apparatus access roads--~Gates. Section 10.207 (m) is added to the Uniform Fire Code to read as follows~ Ail automatic gates across fire access roads shall be equipped with approved emergency key operated switches overriding all command functions and opening the gate. Gates accessing more than four residences or residential lots shall also be equipped with approved emergency traffic control activating strobe sensor(s), which will activate the gate on the approach of emergency apparatus. All automatic gates must meet Fire Department policies deemed necessary by the Chief for rapid~ reliable access. A manual override lock release system will be provided in the event of a power failure. Manual gates shall Ordinance No. 305 Page 7 15.24.130 - 15.24.180 have a Fire Department lock box installed with the gate key inside. 15.24.130 Section 10.208 (a) amended--Premises identifi- cation. Section 10.208 (a) of the Uniform Fire Code is amended by the addition of the following~ Minimum size numbers shall be four inches (4") for single-family dwellings, six inches (6") for multi-family dwellings and commercial buildings and eighteen inches (18") for industrial buildings. 15.24.140 Section 10.208 (c) addition: Roof Numbers. Section 10.208 (c) is added to the Uniform Fire Code to read as follows~ When required by the Chiefs roof numbers shall be installed meeting current Fire Department standards deemed necessary by the Chief. 15.24.150 Section 10.208 (d))addition: Map/Directory. Section 10.208 (d) is added to the Uniform Fire Code to read follows: as A lighted directory map, meeting current Fire Department standards, shall be installed at: (1) each driveway entrance to multiple unit residential projects and mobile home parks, where the number of units in such projects exceed 15, and (2) at the driveway entrance to commercial and industrial projects, where the number of buildings exceed 4. 15.24.160 Section 10.209 amended--Key box. Section 10.209 of the Uniform Fire Code is amended by labeling the existing text as (a), and by addition of subsection (b) to read as follows~ (b) Ail central station-monitored fire detection systems and fire sprinkler systems shall have an approved emergency key access box on site in an approved location. The owner or occupant shall provide and maintain current keys for the structure(s) for fire department placement in the box, and shall notify the fire department in writing when the building is re- keyed. 15.24.170 Section 10.301 (a) amended--Life safety systems and appliance installation. Section 10.301 (a) of the Uniform Fire Code is amended by deletion of the words "other than private dwellings", after the word "jurisdiction" in the first sentence. 15.24.180 Section 10.301 (g) addition-.-Fire hydrants. Section 10.301 (g) is added to the Uniform Fire Code to read follows~ as Ordinance No. 305 Page 8 15.24.190 In zones other than industrial, commercial and multi-family, fire hydrants shall be installed in accordance with Table No. 10.301 (g). Distance requirement is measured to the structure. Table No. 10.301 (g) Parcels one acre and larger~ every five hundred (500) feet. Parcels less than one acre~ every three hundred fifty (350) feet. A. In multi-family zones~ and in commercial and industrial zones, fire hydrants shall be installed every three hundred (300) feet regardless of parcel size. EXCEPTION~ When improved methods of fire protection are provided, beyond those required by the code, and accepted by the Chief~ alternate spacing of fire hydrants as set forth above may be considered. B. Ail fire hydrants shall be of bronze construction, including all internal parts except seats. Alternate materials may be used if approved by the Fire Marshal and the Department of Public Services. The stems shall be designed and installed in a manner that will ensure that they will not be projected outward from the main body by internal water pressure due to disassembly. C. The number and size of fire hydrant outlets shall be as follows: (a) one four inch (4") and one two and one-half inch (2 1/2") NST outlet. (4,', 2 1/2") (b) two four inch (4") and one two and one-half inch (2 1/2") NST outlet (4", 4", 2 1/2") In some instances, the Chief have any other combination of inch (2 1/2") outlets. may require the fire hydrant(s) to four inch (4") and two and one-half 15.24.190 Section 10.301 (h) addition--Residential automatic fire sprinkler system. Section 10.301 (h) is added to the Uniform Fire Code to read as follows: The Chief may require an automatic fire sprinkler system to be installed in dwellings where no water main exists to provide the required fire flow. The automatic fire sprinkler system must be designed, constructed and installed in accordance with the National Fire Protection Association Standards contained in pamphlet 13D and/or 13R. Water meter shall be a minimum of one inch (1") and the water line from the meter to the building shall be a minimum of one Ordinance No. 305 Page 9 15.24.200 inch (1"). The system shall be subject to a test witnessed by the fire agency and include the following: ao Static pressure plus 50 PSI, but not less than 150 PSi. Hydro test for 24 hours. Exceptions: Sprinklers may be omitted from bathrooms. Sprinklers may be omitted from carports and unattached garages. Any garage that is part of the building shall be protected, and sprinkler heads shall be protected against mechanical injury with approved guards. C. A fire alarm signal shall be provided by a water flow switch located on the sprinkler riser and the alarm bell or other audible device shall be of sufficient intensity to be clearly audible in all bedrooms. 15.24.200 Section 10.301 (i) addition--Water tanks. Section 10.302 (i) is added to the Uniform Fire Code to read as follows. Table No. 10.301 (i) sets forth minimum water storage requirements to provide protection for dwellings and other structures. When exposure distance is one hundred feet (100') or less from adjacent property, the following minimum fire flow shall be adhered to. Increase in water storage may be required by the Chief~ depending on the square footage of the exposed structure. Ordinance No. 305 Page 10 15.24.210 NOTE: In areas where water can be supplied by pumps from a domestic source, the capacity of the supply will be analyzed as to the requirements of Section 10.301(c). no Tank elevation shall be equal to or higher than the fire department connection on the premises. Regardless of domestic use, all tanks shall be equipped with a device that will ensure that the tank contains the designated amount of water for fire flow duration as determined by the fire department. Bo Co Supply outlet shall be at least four inches (4") in diameter from the base of the tank to the point of outlet at the fire department connection. The fire department connection shall be at least one four inch (1-4") National Standard Thread male. Additional outlets may be required. Location of fire department outlet shall be determined on the plot plan when submitted to the fire department. Consideration will be given to topography, elevations, distance from structures, driveway access, prevailing winds, etc. The outlet shall be located along a fire apparatus access roadway and shall not be closer than fifty feet (50') nor further than one hundred fifty feet (150') from the structure. Ail exposed tank supply pipes shall be of an alloy or other materials listed for above-ground use. Adequate support shall be provided. Water storage tanks shall be constructed from materials approved by the Fire Marshal and installed per manufacturer recommendations. The Chief of the Fire Department having jurisdiction may require any necessary information to be submitted on a plot plan for approval. 15.24.210 Section 10.302 amended--Exception--Repairs to fire extinguishing system. Section 10.302 of the Uniform Code is amended as follows: aJ Deletion of the exception in 10.302(a); Addition of a new subsection (d): Fire Ail modifications, extensions, and/or repairs to fire extinguishing systems shall be after notification, plan check and proper permit is obtained from the bureau of fire prevention. Ordinance No. 305 Page 11 15.24.220 - 15.24.230 15.24.220 Section 10.303 (a) amended--Portable Fire Extinguishers. Section 10.303 (a) of the Uniform Fire Code is amended by the following: The minimum allowable portable fire extinguishers requirement for any occupancy shall be one (1) 2A:10BC for every 3,000 square feet of building area, placed at a distance not to exceed 75 feet of travel. 15.24.230 Section 10.306 deletion and replacement--Automatic fire extinguishing systems. Section 10.306 of the Uniform Fire Code is deleted and replaced to read as follows: Where Required. An automatic fire extinguishing system shall be installed in the occupancies and locations as set forth in this section. For special provision on hazardous chemicals and magnesium, and calcium carbide, see Sections 10.301 and 45.209 and Articles 48, 49, and 80. Bo Ail Occupancies Except Group R, Division 3 and Group M. Except for Group R, Division 3 and Group M occupancies, an automatic sprinkler system shall be installed: In every story or basement of all buildings when the floor area exceeds 1500 square feet and there is not provided at least 20 square feet of opening entirely above the adjoining ground level in each 50 lineal feet or fraction thereof of exterior wall in a story or basement on at least one side of the building. Openings shall have a minimum dimension of not less than 30 inches. Such openings shall be accessible to the fire department from the exterior and shall not be obstructed in a manner that firefighting or rescue cannot be accomplished from the exterior. When openings in a story are provided on only one side and the opposite wall of such story is more than 75 feet from such openings, the story shall be provided with an approved automatic sprinkler system, or openings as specified above shall be provided on at least two sides of an exterior wall of the story. If any portion of a basement is located more than 75 feet from openings required in this section, the basement shall be provided with an approved automatic sprinkler system. At the top of rubbish and linen chutes and their terminal rooms. Chutes extending through three or more floors shall have additional sprinkler heads Co Ordinance No. 305 Page 1 2 15.24.230 installed within such chutes at alternate floors. Sprinkler heads shall be accessible for servicing. 3. In rooms where nitrate film is stored and handled. In protected combustible fiber storage vaults as defined in this Code. Group A Occupancies. Occupancies A-i, A-2, and A-2.1 shall be fully covered by an automatic sprinkler system. Where A occupancies exist in buildings with other occupancy classes and the entire building exceeds 2,500 square feet the entire building shall be fully covered by an automatic fire extinguishing system. Occupancy A-3 shall be fully covered by an automatic sprinkler system when either the occupant load exceeds 100 people as determined by Uniform Building Code (UBC) Table 33-A or the total building floor area exceeds 2,500 square feet, or the building is greater than one story in height, whichever occurs first. o Basements. An automatic sprinkler system shall be installed in basements classified as a Group A occupancy when the basement is larger than 1500 square feet. Stairs. An automatic sprinkler system shall be installed in enclosed usable space below or over a stairway in Group A, Divisions 2, 2.1, 3 and 4 Occupancies. Other areas. An automatic sprinkler system shall be installed in specific areas of Group A occupancies as follows~ Under the roof and gridiron, in the tie and fly galleries, and in all places behind the proscenium wall of stages; over or within permanent platforms in excess of 500 square feet in area; and in dressing rooms, workshops and storerooms accessory to such stages or permanent platforms. Exceptions: 1. Stages or platforms open to the auditorium room on three or more sides. 2. Altersf pulpits, or similar platforms and their accessory rooms. Ordinance No. 305 Page 1 3 15.24.230 3. Stage gridirons when side-wall sprinklers with 135 F rated heads with heat-baffle plates are installed around the entire perimeter of the stage except for the proscenium opening at points not more than 30 inches below the gridiron nor more than 6 inches below the baffle plate. 4. Under stage or platform areas less than 4 feet in clear height used exclusively for chair and table storage and lined on the inside with materials approved for one-hour fire resistive construction. D. Group B Occupancies. Division B-1. When the total gross floor area exceed 2,500 square feet, full coverage by automatic fire sprinklers is required. No requirement for automatic fire sprinklers if such building is separate from all others by at least 50 feet. Otherwise, if close to, or part of other buildings, B--1 occupancies will be fully covered by automatic fire sprinklers. Division B-2. When the total gross £1oor area for any division B-2 occupancy exceeds 2,500 square feet the occupancy will be fully covered by automatic fire sprinklers. Divisions B-3 and B-4. Full coverage by automatic fire sprinklers is required when the occupancy total gross square footage exceeds 2,500 square feet. Group E Occupancies will follow the requirements of the California State Fire Marshal as set forth in California Administrative Code Title-19 and Title--24. Basements. An automatic sprinkler system shall be installed in basements classified as a Group E Occupancy when the basement is larger than 1,500 square feet in floor area. F. Group H Occupancies. Division 1. An automatic fire-extinguishing system shall be installed in Group H~ Divisions 1, 2~ 3~ 4 and 7 Occupancies. Division 6. An automatic fire-extinguishing system shall be installed throughout buildings containing Group H, Division 6 Occupancies. The design of the sprinkler system shall be not less Ordinance No. 305 Page 14 15.24.230 than that required under U.B.C., 1988 Edition and U.B.C. Standard No. 38-1 for the occupancy hazard classification. Group I Occupancies shall follow in the requirements of the California State Fire Marshal as set forth in California Administrative Code Title-19 and Title-24. As such, all I occupancies are required to have full automatic fire sprinkler systems, with exceptions as noted by the State. Group R Occupancies. Group R-1. Full automatic fire sprinklers are required in units used for commercial rental (co~only known as hotels, motels) when the number of units per building exceed 5. In such units when the units per building do not exceed 15, the sprinkler design standard shall be the residential one as set forth in NFPA 13D. Sprinklers are not required on condominiums or apartment buildings two stories or less in height, or less than 12,000 square feet per floor, or 24,000 square feet total gross floor area. 2 o Group R-3. Sprinklers are not required, but are an encouraged option. The residential sprinkler standard shall be that set forth by the bureau of fire prevention. Residential sprinklers may be used in lieu of a standby water requirement when fire hydrants are not closely available. General. o When any building, unless a State Fire Marshal regulated occupancy, exceeds 2,500 square feet total floor plan area, the building shall be fully covered by an automatic fire extinguishing system. Contiguous buildings or structures, such as shopping centers shall be considered as one building where linked by common walls, roofs or walkways. Buildings subsequently constructed shall be considered one building requiring compliance of both buildings when exceeding 2,500 square feet. Type V buildings or structures separated by less than ten (10) feet shall be considered as one building or structure. The City of Poway Automatic Fire Extinguishing System Requirements are not intended and shall not limit Uniform Building Code allowable area and construction type increases, as if the sprinklers had been voluntarily selected. Ko Ordinance No. 305 Page 15 15.24.230 4 o Where sprinklers are required by just this ordinance, rated fire walls and area occupancy separation walls, shall not be used to divide a building into smaller areas so as to just eliminate any applicable automatic extinguishing system requirements. Buildings built on a property line other than a public way shall be protected by a fire sprinkler system consistent with the forgoing standards, regardless of size. In any building hereinafter constructed which does not fall into the above categories, where the required fireflow exceeds 2,500 gallons per minute, calculated according to the standard published by the Insurance Services Office, "Guide for Determination of Required Fire Flow", the Chief shall require the installation of an automatic fire sprinkler system meeting Uniform Building Code Standard 38-1. Standards. Ail sprinkler system installations shall be in conformance with the latest edition of the National Fire Protection Association's (NFPA) Standard 13, 13R and 13D. Other engineering standards as may be required will be published by the Bureau of Fire Prevention. Plans. Required automatic fire extinguishing systems shall be approved by the Director of Safety Services or his/her designee. Plans shall be submitted prior to any installation commencing by a licensed system designer and/or installer. Plans shall be approved prior to installation beginning. Plans shall show all necessary engineering features and calculations to document compliance with and as required by NFPA 13, 13R and 13D. Standard test during and after installation shall be required as by NFPA 13, 13R 13D, and fire prevention bureau standards. These tests must be performed and documented prior to final inspection. No building hereafter required to have an automatic fire extinguishing system installed shall pass final building inspection or be issued Ordinance No. 305 Page 16 15.24.230 - 15.24.260 a certificate of occupancy until the fire extinguishing system passes final fire inspection. If the Bureau of Fire Prevention need specialized consultant assistance for plan checks or if extensive inspections/reinspections are required during installation, a reasonable fee shall be charged to cover expenses. Fees shall be established by resolution of the City Council. o For commercial and industrial occupancies commonly referred to as "spec buildings" wherein no specific end use is identified at time of plan check~ the sprinkler system shall provide a density of .33 GPM/sq. ft. for a 3~000 sq. ft. design area. Projects having paid a building plan check fee prior to adoption of this ordinance are exempt from this ordinance's additional sprinkler requirements, but not those of the currently adopted Uniform Building Code. 15.24.240 Section 10.307 deletion and replacement .... Sprinkler System Supervision Alarms. Section 10.307 of the Uniform Fire Code is deleted and replaced to read as follows~ Ail automatic fire sprinkler systems meeting UBC Standard 38--1 or NFPA 13 shall be supervised by an approved central station monitoring for water flow meeting fire department standards. All control valves shall be monitored for tampering by central station and be locked by approved padlocks keyed to fire department specifications. All monitored sprinkler systems shall have approved emergency access key boxes on site at a location approved by the fire department. 15.24.250 Section 10.314 addition--Specifications. Section 10.314 is added to the Uniform Fire Code to read as follows: The Fire Chief shall write and update as necessary specifications for the installation and maintenance of all onsite fire extinguishing or fire protection systems. These specifications shall be set forth as the minimum requirements for fire protection equipment acceptable to the fire department and Director of Public Works. 15.24.260 Section 11.201 amendment--Dumping of waste material. Section 11.201 of the Uniform Fire Code is amended by adding subsection (e) to read as follows: eo Dumping of waste material as defined in California Penal Code, Section 374(b), is prohibited within the jurisdiction except at approved landfills. Ordinance No. 305 Page 17 15.24.270 - 15.24.300 The property owner and person in control of the property shall not permit such material to remain on the site, and shall remove it or cause it to be removed to an approved landfill or State licensed hazardous waste materials disposal station, as appropriate. The property owner or person in charge shall take such actions as necessary to prevent recurring dumping, such as posting the property and fencing the area or barricading the access. Such fencing or barricading shall not be installed so that firefighting access is compromised. After reasonable notice and opportunity for compliance per the California Health and Safety Code, the City Council may authorize the Chief to employ a contractor to remove waste material from the site, and attach actual contractor costs and a reasonable administrative fee as a lien against the property. 15.24.270 Section 11.208 amendment--JPermits. Section 11.208 of the Uniform Fire Code is amended by deletion of subsection (a), permit to operate a parade float. 15.24.280 Section 11.403 amended--Asphalt kettles. 11.403 of the Uniform Fire Code is amended to re-label subsections to (b) and (c), and add subsection (a) ~ Section existing (a) For permits to operate an asphalt kettle, see Section 4.108. 15.24.290 Section 25.401 (b) deletion and replacement-- Ground Seats. Section 25.401 (b) of the Uniform Fire Code is amended by deletion and replacement with: Where more than 299 loose chairs are used in connection with athletic events, or outdoor events, chairs shall be fastened together in groups of not less than three and shall be tied or staked to the ground. 15.24.300 Section 79.501 amendment .... Restricted locations- stationary tank storage, aboveqround, outside of buildings. Section 79.501 of the Uniform Fire Code is amended to re-label existing subsection as (a) and add subsection (b): (b) The storage and dispensing of Class I and II from above-ground tanks is permitted in quantities in specially designed containers certain land use or occupancy areas as follows liquids limited within The maximum Class I or II liquids permi~ted per assessor parcel shall be 550 gallons. Ordinance No. 305 Page 18 15.24.310 - 15.24.320 2 o Above-ground storage in tanks of Class I and II liquids is prohibited on residential property. Specially designed tanks must be approved by the Chief~ and must meet the following minimum requirements~ (a) The primary vessel shall be of double containment design. (b) The primary vessel shall be protected by an integral exterior weather resistive, fire- resistive barrier with a minimum rating of two (2) hours. (c) The vessel shall be placed on a concrete foundation meeting seismic design requirements and soil compaction standards. (d) Venting shall meet Fire Code and Air Pollu- tion Control District standards. (e) A concrete containment curb is required, with a minimum rise of 6" and located at least 12" outside the perimeter of the tank. A manually operated, self-closing drain shall be provided for removal of rain water from the diked area. (f) Collision barriers of substantial construction, and spaced to prevent contact by a vehicle, shall be provided. (g) 'NO SMOKING' signs shall be provided, and the tank marked by UFC Standard 79-3 requirements on all sides. (h) Bouyancy calculations shall be provided for all tanks placed within the 100 year floodR plain. 15.24.310 Section 79.903 (b) amendment--Dispensing services- supervision. Section 79.903 (b) of the Uniform Fire Code is amended by addition of subsection (4) under EXCEPTION to read as follows: In the immediate vicinity of the sign described at (2) above, there shall be provided an approved method of notifying the fire department in the event of an emergency. Such method shall consist of a telephone capable of emergency communications without the use of a coin, or other approved means, and shall be readily accessible to the public. 15.24.320 Section 79.908 amendment---Card controlled stations Section 79.908 of the Uniform Fire Code is amended by adding a new subsection (a) to read as follows: Ordinance No. 305 Page 19 15.24.330 - 15.24.350 Card Controlled Stations. Where automatic debit card systems replace the required station attendant in gasoline dispensing stations open to the public, an automatic fire extinguishing system shall be installed as per specifications issued by the bureau of fire prevention. 15.24.330 Section 79.1007 (g) deletion--Tanks for Gravit~ Discharge on Construction Projects. Section 79.1007 (g) of the Uniform Fire Code is amended by deletion of subsection (g), prohibiting their use. 15.24.340 Appendix I-A amended--Regulations applicable to existing buildings. Appendix I-A of the Uniform Fire Code is amended as follows~ 1. GENERAL (a) Purpose: the EXCEPTION. Delete the words "Group R, Division 3" from 2. BASEMENT ACCESS OR SPRINKLER PROTECTION - Add new subsection (a) as follows: Where an existing building or structure is not protected by an automatic fire extinguishing system, but would otherwise be required to be protected if built as a new building, its use will be allowed to continue until such time any structural change takes place which modifies, alters~ or affects, any bearing wall or similar structural assembly at which time it shall be made to conform to the provisions of this Code. 3. Add new Section 8 to read as follows: ABOVE-GROUND TANKS. Any existing, but non-conforming above-ground flammable or combustible liquid storage tank shall be made to conform with the adoption of this Code. 4. Add new Section 9 to read as follows: KITCHEN EXTINGUISHING SYSTEMS. Any commercial kitchen not meeting the fixed protection requirements for hoods and ducts as specified in Section 10.313 shall be made to conform with the adoption of this Code. 15.24.350 APPENDIX II-A addition--State Fire Prevention Guides. Appendix II-A of the Uniform Fire Code is adding new Section 24 to read as follows: 24. State Fire Prevention Guides. amended by Ordinance No. 305 Page 20 15.24.360 - 15.24.370 This code hereby adopts the following fire safety guides by reference for industrial, commercial and/or residential de- velopment in, upon or adjoining any mountainous area or forest-- covered lands, brush-covered lands or grass-covered lands or any lands covered with flammable material: (a) Fire Safe Guides for Residential Development California (1980), California Department of Forestry; in (b) Industrial Operations Fire Prevention Field Guide (1980), United States Forest Service. (c) A Homeowner's Guide to Fire and Watershed Management at the Chaparral/Urban Interface, U. S. Forest Service, Department of Agriculture. Wherever a conflict exists in this Code, the more strictive requirements shall apply. 15.24.360 APPENDIX II-E addition Hazardous materials management plan and hazardous materials Inventory Statement. Appendix II-E of the Uniform Fire Code is amended by adding the following paragraph to read: 1. INTENT Hazardous Materials reporting forms currently adopted by San Diego County Health Department, Hazardous Materials Management Unit which cover the same areas as forms contained in this appendix are adopted by reference and take precedence over this appendix. III. SPECIAL REGULATIONS 15.24.370 New materials, processes or occupancies which may require permits. A. The Chief and Chief of the Bureau of Fire Prevention shall act as a committee to determine and specify, after giving affected person an opportunity to be heard, any new materials, processes, or occupancies for which permits are required in addition to those now enumerated in said Code. The Chief of the bureau of fire prevention shall post such list in a conspicuous place in the bureau, and distribute copies thereof to interested persons. B. From time to time, in order to clarify, interpret, or administer this Code, the bureau of fire prevention may issue written stan~.ards which shall have the full force and effect of this Code. 15.24.380 Ordinance No. 305 Page 21 15.24.380 - 15.24.410 Establishment of limits of districts in which storaqe of flammable or combustible liquids in outside above- ground tanks is to be prohibited. (a) The limits as amended in Section 79.501 of the Uniform Fire Code in which storage of flammable or combustible liquids in outside above-ground tanks is prohibited are hereby established as the jurisdictional limits of the City of Poway. A permit shall be obtained from the Bureau of Fire Prevention prior to engaging in this activity. EXCEPTIONS: 1. 550 gallons maximum temporary above-ground tanks storage for private use on remote construction sites, earth moving projectsf gravel pits or borrow pits. 2. Crankcase draining may be stored in specially constructed above-ground storage tanks, approved by the Chief, with a maximum capacity of 550 gallons. 3. A maximum of 550 gallons of flammable or combustible liquid may be stored above-ground in tanks in rural residential zones for agricultural use, and in zones identified for such use by the Department of Planning Services, with the approval of the Chief and with safeguards as described in Section 79.501(b) of this Code. Above-ground storage in tanks of flammable and combustible liquids for vehicle fuel is prohibited in residential areas. (b) Bulk plants or terminals, as described in Section 79.1401 through 79.1410, are prohibited within the jurisdiction. 15.24.390 Establishment of limits in which storage of liquefied petroleum gases is to restricted. The limits referred to in Section 82.104(b) of the Uniform Fire Code, in which storage of liquefied petroleum gas is restricted, are established as follows: In residential zones LP gas use tanks shall not exceed five hundred gallons for residential use. In commercial and manufacturing zones LP gas tanks shall not exceed one thousand two hundred gallons for limited commercial use. LP gas bulk storage and transfer facilities are not permitted within the City limits. 15.24.400 Establishment of limits of districts in which storages of explosives and blasting agents is to be prohibited. The limits referred to in Section 77.106(b) of the Uniform Fire Code, in which storage of explosives and blasting agents is prohibited, are established as the limits of the City. IV. VIOLATION--PENALTY 15.24.410 Violation--Penalt¥.. A. Any person who shall violate any of the provisions of this Code or Standards hereby adopted, or fail to comply therewith, or who shall violate or fail to comply with any order made thereunder, or who shall build in violation of any detailed statement or specifications or plans Ordinance No. 305 Page 22 submitted and approved thereunder, or any certificate or permit issued thereunder, and from which no appeal has been taken~ or who shall fail to comply with such an order as affirmed or modified by the City Attorney or by a court of competent jurisdiction, within the time fixed herein, shall severally for each and every such violation and noncompliance, respectively, be guilty of a misdemeanor, punishable by a fine of not less than one hundred dollars ($100) nor more than five hundred dollars ($500) or by imprisonment for not less than ten (10) days nor more than six (6) months or by both such fine and imprisonment. The imposition of one penalty for any violation shall not excuse the violation or permit it to continue; and all such persons shall be required to correct or remedy such violations or defects within a reasonable time; and when not otherwise specified, each ten days that prohibited conditions are maintained shall constitute a separate offense. B. The application of the above penalty shall not be held to prevent the enforced removal of prohibited conditions. Section 2: EFFECTIVE DATE: This ordinance shall take effect and be in force thirty (30) days after the date of its passage; and the City Clerk of the City of Poway is hereby authorized to use summary publication procedures pursuant to Government Code Section 36933 utilizing the Poway News Chieftain~ a newspaper of general circulation published in the City of Poway.
