Res 83-045RESOLUTION NO. 83-045 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA REVISING TRAFFIC MITIGATION FEES RESULTING FROM NEW DEVELOPMENT AND RESCINDING RESOLUTION NO. 309 WHEREAS, within the City of Poway many thousands of acres of land will be developed through procedures as prescribed by the Subdivision Map Act, State of California Government Code Section 66410 et seq; and WHEREAS, within the City of Poway many acres of land will be dev.~loped through procedures prescribed by the City's building permit process; and WHEREAS, such development of properties facilitates development having an impact on the infrastructure of the City of Poway including traffic impacts to public roads and bridges; and WHEREAS, the City Engineer has identified the roads and bridges that will be impacted by the traffic impact of new development within the City of Poway; and WHEREAS, the City Engineer has determined and calculated cost to mitigate the traffic impacts created by new development through the construction or reconstruction of roadways, bridges and traffic signals; and WHEREAS, the City Engineer has determined that traffic impacts created by new development is related to the daily vehicle trips generated by the new development, and calculated from vehicle trip generation factors deemed applicable by the City Engineer as obtained from the latest publication of the Institute of Transportation Engineers, San Diego Association of Govern- ments, City of San Diego, and others which are deemed appropriate; and WHEREAS, the City Council through the proposed General Plan process must specifically add conditions to a proposed project to mitigate the traffic impact on the community's infrastructure prior to approval; and WHEREAS, the failure to impose such conditions would adversely impact the health, safety, and welfare of all residents of the City of Poway. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF POWAY DOES RESOLVE, DETERMINE AND ORDER AS FOLLOWS: Section 1. Mitigation Conditions. A Traffic Mitigation Fee of $66 per vehicle trip shall be required as a condition of approval of a final map or a building permit, notwithstanding additional requirements of the Subdivision Map Act or City Council. The Traffic Mitigation Fee required shall be the fee that is in effect at the RESOLUTION NO. 83-045 PAGE 2 time of the approval of the final map or receipt of a building permit. The vehicle trips per development shall be in accordance with "City of Poway-Trip Generation Factors" per Exhibit "A" attached hereto and made a part of this Resolution. Property being developed under the building permit process, i.e., conversions, renovations, remodels, etc. shall only be assessed a Traffic Mitigation Fee if the cost of the modification is at least 50% of the market value of the property prior to the modification. Section 2. Developments Other Than Residential. The Traffic Mitigation Fees for developments other than residential shall be 25% of the calculated fee based upon the trip generation factors shown in Exhibit "A". Section 3. Credits. A credit not to exceed the calculated Traffic Mitigation Fee for any development shall be given for the construction of circulation element improvements. The City Engineer shall calculate the credit based upon unit prices used in calculating the cost estimates for the ultimate circulation element improvements. Section 4. Time of Payment. Traffic Impact Mitigation Fees shall be payable at the time of City Council approval of the final map. If property is being developed without the aid of a final map then the Traffic Impact Mitigation Fee shall be payable at the issuance of a building permit. Section 5.
