A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA,
OPPOSING THE ACTION OF THE
STATE L~GIS~RE TO CONFISCATE
WHEREAS, the State Legislature has adopted and the Governor has signed a
State budget which eliminates state subventions to cities; and
WHEREAS, the City of Poway stands to lose $880,749 as a result of this
action including $794,357 in motor vehicle in-lieu fees and $86,392 in cigarette
taxes; and
WHEREAS, these revenue sources have traditionally ~n revenues used by
local government to provide for the health, safety and welfare of the local
citizenry; and
WHEREAS, the State began collecting motor vehicle fees and subventing these
funds back to local goverrm~ent in lieu of local governments collecting a
property tax on motor vehicles; and
WHEREAS, until 1967 cigarette taxes were a source of revenue collected at
the local level; and
WHEREAS, the confiscation of these funds requires local government and thus
the local citizenry to bail the State cut of its financial difficulties; and
WHEREAS, the City of Poway has never asked for nor received any bail-cut
funds fr~n the State of California; and
WHEREAS, legislation has ~cn proposed to force local government to do with-
out these traditional local revenues or to increase the local sales tax by one
cent.
NOW, THEREFORE, BE IT RF-qOLVED, that the City Council of the City of Poway
strongly opposes this unprecedented action by the State Legislature and makes an
appeal to the Legislature to overturn their prior action by repealing the AB 8
deflator so that these funds can be returned to local government and strongly
urges that they reject any legislation designed to offset these funds by
requiring local goverr~ent to do without these funds or impose a local sales
tax.
