A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA,
PRESCRIBING MINISTERIAL PERMIT FEES
FOR STRUCTURES REGULATED BY NEW STATE
MANDATED ENERGY CONSERVATION REGULATIONS
FOR RESIDENTIAL BUILDINGS
WHEREAS, the State of California has mandated the City to commence
enforcement on June 16, 1983 of the new State mandated Energy Conservation
Regulations for residential buildings; and
WHEREAS, it is the intent of the City Council to establish fees reflecting
the full cost of enforcing building regulations; and
WHEREAS, Section 51.212 et. seq. of the City Code authorizes the City
Council to establish fees for various building construction permit applications
by resolution; and
WHEREAS, the fee coz~ittee of the San Diego Chapter of the International
Conference of Building Officials has estimated the costs for enforcing the new
regulation and recommended that the Building Permit and Plan Check Fee be
raised 20% for structures regulated by the new State mandated Energy
conservation Regulations for residential buildings; and
WHEREAS, the Construction Industry Federation has recommended that any new
fee not exceed one-half of the fee recommended by the committee of the San
Diego Chapter of the Internationl Conference of Building Officials.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway
that prescribed building permit and plan check fees shall be increased,
effective this date by 10% for those structures regulated by the new State
mandated Energy Conservation Regulations for residential buildings.
