Res 83-065RESOLIFfION NO.. 83-065 A RESOLUTION OF THE CITY COU~]CIL OF THE CITY OF POWAY, CALIFORNIA CERTIFYING THE FINAL ENVIRO~{ENTAL ]I~PACT REPORT FOR THE CITY OF PC~AY COMPREHENSIVE PL~,I WHEREAS, the City Council of the City of Poway recognizes the need to protect the co~m,anity's natural and human environment; and WHEREAS, it was found that the City of Poway Comprehensive Plan may have potential adverse environmental effects and a Draft Environmental Impact Report was caused to be prepared; and WHEREAS, the Draft Environmental Impact Report was prepared according to the California Environmental Quality Act utilizinR con. unity meetings and a formal Notice of Preparation to assist in preparation; and, WHEREAS, those corments received either verbally or in writing have been responded to and the Final Environmental Impact Report has been prepared in accordance with the requirements of the California Environmental OualityAct. NCN, THEREFORE, BE IT RESOLVED, the City Council does hereby certify the Final Environmental Impact Report of the City of Poway Comprehensive Plan which includes all con~nents and responses on the Draft Fmvironmental Impact Report, the Draft Part Three: The Environmental Analysis Section, Part One: %he General Plan, and Part Two: %he Zoning Development Code. BE IT FURTHER RESOLVED, the City Council adopts the attached Exhibit A, the STATE~?F OF OVERRIDI~ COt~IDERATIONS for those adverse impacts identified ia the Final Environmental Impact Report that could not be adequately mitigated to a insignificant level. The City Clerk of the City of Poway is hereby directed by the City Council to file a ~btice of Determination with the County Clerk of the County of San Diego in accordance with the California Environmental Ouality Act. Oravec~.hyor /dT 'IiqT: EXHIBIT A STATSMENT OF OVERRIDING CONSIDERATIONS The California Environmental Quality Act Guidelines specifically state that no public agency shall approve or carry out a project for which an EIR has been completed which identifies one or more significant environmental effects of the project unless the public agency makes one or more written findings for each of those significant effects. The written findings are commonly known as statements of overriding considerations. Statements of overriding consideration allow the decision-making body to determine if the benefits of a project outweigh theunavoidable adverse environmental effects, the adverse environmental effects may be considered "acceptable." land Use The growth anticipated by the Comprehensive Plan will convert undeveloped areas of the City to some form of development, principally low-density residential. This is offset by the objectives of the General Plan that encourage in-fill development and discourage development outside of the existing developed area. Therefore, although growth will impact the City, the impact on the coL~unity's desire to retain open space and a rural character is significantly reduced. Air Quality The growth anticipated by the Comprehensive Plan will contribute more air pollutants than are bein~ contributed today. The Plan has several sections which reduce the amo~mt of pollutants to the least feasible amount including an Air Quality Element, but it is impossible to mitigate the problem entirely. The City of Poway's contribution to increased air pollutants is a small fraction of the overall increase anticipated on a regional scale. Water Oualitv %he water quality of local surface and groundwater will be affected with additional pollutants as a result of increased growth. These pollutants ~uld be principally from increased refuse and automobile fluids being washed from City roadways into the local surface of Kroundwater system. Although the City's street sweeping proKram will mitigate the impact to a certain extent, it cannot fully mitigate the problem. Traffic %he proposed Midland Road extension from Twin Peaks Road to Espola Road has been eliminated to reduce the impacts on adjacent residential ~ellin~s. As a result, the Citvwide Traffic Studv has noted that Espola Road will have to acco~.n~oda[e more traffic than capacity will allm~ as a secondary arterial. ~pota Road, however, will remain a secondary arterial to preserve the rural character of the adjacent area.
