A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY,
CALIFORNIA, STATING ITS INTENTION TO VACATE AND ABANDON AN EASEMENT
FOR OPEN SPACE PURPOSES ON PROPERTY ON LARRY STREET, EAST OF
LUIS STREET, AND SETTING A PUBLIC HEARING DATE
(VACATION NO. 83-01)
WHEREAS, there has been requested the vacation of the hereinafter described
open space easement, and
WHEREAS, Chapter 3 of Part 3 of Division 9 of the State of California
Streets and Highways Code, commencing at Section 8320, provides that the City
Council may, by resolution, declare its intention to vacate any easement, and
WHEREAS, a public hearing is required at which all interested parties may
give evidence and testimony as to whether the hereinafter described open space
easement is necessary for any present or prospective public use and if it
should or should not be vacated.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway
that it is the intention of this Council to vacate and abandon the following
described open space easement pursuant to the procedures prescribed in
Chapter 3, Part 3, Division 9 of the Streets and Highways Code:
That certain easement for open space purposes over, under, along,
and across that portion of Lot 230 of Rancho Verde Unit No. 5, in
the City of Poway, County of San Diego, State of California,
according to Map thereof No. 7578 filed in the Office of the County
Recorder of San Diego County as described in the Corporation Easement
Deed recorded on December 14, 1978, at File/Page No. 78-537906 of
Official Records, San Diego County, California.
Said open space easement affects Parcel 2 of Parcel Map No. 8446,
recorded on February 22, 1979 in the office of said County Recorder
(Assessor Parcel No. 314-580-41).

IT IS ORDERED that Tuesday, December 13, 1983, at the hour of 7 o'clock
at City Hall Council Chambers, 13325 Civic Center Drive, is fixed as the
and place for a public hearing on this matter.
IT IS FURTHER ORDERED THAT THE City Clerk of this City give notice of the
passage of this resolution and of the time and place fixed for the hearing by
publication of a notice therefor in the "Poway Chieftain", a newspaper of
general circulation published in the County of San Diego, for at least two
successive weeks prior to said day fixed for said hearing, and that the Clerk
also cause similar notices to be conspicuously posted along the line of said
open space easement proposed to be vacated as above described.
