A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA,
CERTIFYING AS TO ITS REVIEW OF THE
FINAL EIR WITH RESPECT TO THE ADOPTION OF
THE REDEVELOPMEN~ PLAN FOR THE
PAGUAY REDEVELOPMEN~ PRO3ECT AhD
MAKING C_W. RTAIN FIhI)INGS
WHEREAS, the C~,¥Lunity R~develop~ent Agency of the City of Poway (the
"Agency") has prepared and approved a Draft EIR with respect to the adoption of
a Redevelopment Plan (the "R~develo~anent Plan") for the Paguay R~development
Project (the "Project"); and
WHEREAS, pursuant to notice duly given, the Agency and the City Council of
the City of Poway have held a full and fair public hearing on the proposed
Redevelopment Plan and Draft EIR.
NOW, THEREFORE, THE CITY CfYJNCIL OF THE CITY OF POWAY DOES HERW. RY RESOLVE AS
FOLLOWS:
Section 1. A full and fair public h~ring having ~_cn held on said Draft EIR
and the City Council having considered all c~t~%~nts received thereon, which ccml-
ments and responses thereto have been attached to said Draft EIR and incor-
porated therein, the Draft EIR is hereby approved and adopted as the Final EIR
for the adoption of the Redevelopment Plan.
Section 2. The City Council hereby certifies t_hAt the Final EIR for the adop-
tion of the Redevelo[anent Plan has been cc~pleted in c~L%~liance with the
California Environmental Quality Act of 1970 and the state and local environ-
mental guidelines and regulations and that it has reviewed and considered the
Final EIR and the information contained therein.
Section 3. The City Council hereby finds with respect to the adverse environ-
mental impacts detailed in the Final Environmental Impact Report:

That the adverse environmental impacts associated with the adoption of
the Redevelopment Plan have been considered and recognized by the City
Council.
The cc~nents and responses made during the public h~ringof the Agency
and City Council have ~n considered and recognized by the City
Council and will be incorporated into the Final EIR.
That based on the information set forth in the Final EIR the City
Council finds and determines that measures to mitigate the significant
adverse environmental impacts, identified in the Final EIR, exist and
are included in the Final EIR, except as provided for in Section 3(D)
of this resolution.

That as to certain adverse impacts the City Council finds and deter-
mines that said adverse impacts cannot be entirely mitigated due to the
involvsment of activities outside the jurisdiction of the Agency and
the City of Poway as more particularly described in Exhibit "A." The
Stat~nent of overriding considerations attached hereto and incorporated
by reference.
Section 4. The City Council hereby finds and determines that all potential
impacts on the enviromnent cannot be entirely or feasibly eliminated. The City
Council hereby finds that, based on the testimony presented in connection with
the approval of the Redevelotm~nt Plan referred to in the recitals and based on
Exhibit "A" attached hereto and incorporated herein by reference, the beneficial
econc~ic and social effects of the Project override such potential adverse
impacts.
Section 5. The City Council hereby finds and determines tb~t all measures
have been incorporated into the Redevelofanent Plan which will mitigate or avoid
any significant envirorunental effects that can feasibly be mitigated or avoided.
Section 6. The City Clerk of the City of Poway, in cooperation with the
Executive Director of the Agency, is hereby authorized anddirectedto file with
the CountyClerkof the County of San Diego, a Notice of Determination, pursuant
to 13 California Administrative Code Section 15085(h).
Section 7. This resolution shall take effect i~nediately upon its adoption.
PASSED, ADOPTED AND APPROVED, by the City Council of the City of Poway,
California, at a regular m~-cting thereof this 6th day of December, 1983.
