Res 84-001~OLUTION NO. 84-001 A RESOILTION OF THE CITY COUNCIL OF THE CITY OF Pf~AY, CALTWORNIA, ASKING THE COUNI~ OF SAN D/2~GO FLOOD CONTROL DISTRICT TO INITIATE DETAChmENT OF THE CITY OF POWAY FROM THE FLOOD CON15IOL DISTRICT P~IEREAS, the proposed alternate "B" changes to the Flood Control District Act would remove cities fr~n the Flood Control District; and WHEREAS, the City of Poway passed l~solution No. 83-079 opposing Alternate "B" changes to the District Act; and WHEREAS, the City of Poway is within Zone 1 of the Flood Control District; and WHEREAS, the southerly drainage basin of the City of Poway is within a special Poway Flood Control District subzone that was approved at a special election of the voters within the subzone boundary to finance drainage improve- ments only within the drainage basin; and WHEREAS, County staff has estimated that approximately $162,500 in incre- mental property taxes for Zone 1 are collected within Poway; and WHEREAS, County staff has estimated that approximately $170,000 in incre- mental property taxes for Subzone 1 are collected within Poway; and WHEREAS, incremental property taxes collected by the Flood Control District can only be used for flood control purposes; NOW, THEREFORE BE IT RESOLVED, that the City Council of the City of Poway does resolve that if the Board of Supervisors agree to transfer all incremental flood control property taxes and any present fund reserves collected frc~n Zone 1 and Subzone 1 to the City of Poway, the City agrees as follows: 1. To support Alternate "B" revisions to the Flood Control District Act. 2. To support detachment of the City of Poway from the Flood Control District. 3. To accept the transfer of ownership of all the Flood Control District owned facilities within the City of Poway. 4. To hold the County harmless from all liability after the detackm~__nt date from the Flood Control District.
