A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
VACATING AND ABANDONING AN EASEMENT
FOR OPEN SPACE PURPOSES ON PROPERTY
ON LARRY STREET, EAST OF LUIS STREET
(VACATION NO. 83-01)
WHEREAS, there has been requested the vacation of the hereinafter
described open space easement, and
WHEREAS, on November 15, 1983, the City Council of the City of
Poway delcared its intention to vacate the said open space easement, and
WHEREAS, on December 13, 1983, a duly advertised and posted public
hearing was held, and
WHEREAS, no significant environmental effects were determined and a
Negative Declaration is hereby issued, and
WHEREAS, it appears to this Council that said hereinafter described
open space easement is not needed for present and/or prospective use;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Poway as follows:
Pursuant to Chapter 3 of Part 3 of Division 9 of the
State of California Streets and Highways Code, the
following described open space easement is hereby
vacated and abandoned:
That certain easement for open space purposes over,
under, along, and across that portion of Lot 230 of
Rancho Verde Unit No. 5, in the City of Poway, County
of San Diego, State of California, according to Map
thereof No. 7578 filed in the Office of the County
Recorder of San Diego County as described in the
Corporation Easement Deed recorded on December 14, 1978,
at File/Page No. 78-537906 of Official Records,
San Diego County, California.
Said open space easement affects Parcel 2 of Parcel Map
No. 8446, recorded on February 22, 1979 in the office
of said County Recorder (Assessor Parcel No. 314-580-41).

This vacation shall not affect the easements for open space
described in the Grant of Open Space Easement (corrected)
recorded on June 10, 1983, at File/Page 83-195199 of Official
Records, San Diego, California.

3. That this vacation shall not be deemed complete until this
resolution is recorded in the Office of the County Recorder.
PASSED and ADOPTED by the City Council of the City of Poway,
