A 9F-ROLUTION OF THE CITY COUNCIL
OF THE CITY OF PO~AY, CALIFORNIA,
DETERMINING THAT A CONCRETE BLENDER
MAY BE A USE PERMITTED WITHIN AN
MQUIPMENT RENTAL YARD
WHEREAS, on May 15, 1984, the City Council held a hearing on the above
referenced item under the Clarification of Ambiquity Section of the Zoning
Develo~L~_nt Code (Section 1.4) to determine if a concrete blender my he an
acceptable use within an equipment rental yard; and
WHEREAS, the City Council made the following findings at said hearing:
a. t_hat concrete blending operations are cc~monly conducted in equip-
m~nt rental yards in San Diego County; and
that a small scale concrete blending operation was contemplated by
the City Council as a use properly associated with an "equilm~-nt
rental yard" as that term was used in Section 3.1B.20 of the
Zoning Development Code when that section was adopted, provided
that all equil~ent rental yards would require a conditional use
permit; and
WHEREAS, the conditional use permit process will assume that only concrete
blending operations of a type and scale compatible with surrounding uses on a
case by case basis will be considered, and if approved, only subject to con-
ditions which will appropriately mitigate the effects thereof on the public and
surrounding private property owners.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway, as
follows:
that a concrete blender may be a use permitted within an "equipment
rental yard" as that tern is used in Section 3.1B.20 of the Zoning
Develolm~_nt Code subject to a case by case determination of compati-
bility through the conditional use process.
PASSED, ADOPTED AND APPROVED, by the City Council of the City of Poway,
