A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF POWAY, CALIFORNIA, VACATING A
UTILITY EASEMENT RESERVATION

WHEREAS, there has been requested the vacation of the
hereinafter described utility easement reservation, and
WHEREAS, on May 1, 1984, the City Council of the City of
Poway declared its intention to vacate the said utility easement
reservation by its passage of City Council Resolution No 84-028
and ' '
WHEREAS, on May 22, 1984, a duly advertised and posted public
hearing was held on the vacation request,
NOW THEREFORE, BE IT RESOLVED by the City Council of the City
of Poway as follows:
1. The City Council hereby finds that

The vacation of the said utility easement
reservation will not have a significant
effect upon the environment.
b. There were no written or oral protests or
objections to the said vacation.
The utility easement reservation is not
needed for any present or prospective
public use.
Pursuant to Chapter 3 of Part 3 of Division 9 of
the State of California Streets & Highways Code,
the following described utility easement reservation
is hereby vacated and abandoned:
Ail that portion of that certain utility easement
as reserved by the County of San Diego from its
vacation of Sixth Street, between Pomerado Road
and Eisenhower Avenue, in the resolution adopted
on January 29, 1974, by the Board of Supervisors
of San Diego County, California and recorded on
February 6, 1974 as File No. 74-031303 of Official

Records, lying within the boundary of Parcel 1
of Parcel Map No. 10986, filed on February 12,
1981, in the office of the County Recorder of
San Diego County, (Assessor Parcel No. 317-031-58),
and lying within those portions of Block 28 of
Tract "F" of the "Map of Poway", according to
map thereof No. 536, filed in the office of the
said County Recorder, on May 7, 1888, together
with portions of the south half of Sixth Street
and the westerly half of Pomerado Road (formerly
Escondido Avenue) and of the alley lying between
said Block 28 and Lot 29, as said alley was
vacated, lying southerly of the centerline of
said Sixth Street, lying westerly of the west
line of said Pomerado Road, lying northerly of
a line which is 60 feet south of and parallel
with the centerline of said Sixth Street, and
lying easterly of the west line of the said
alley and its northerly projection thereof
(Assessor Parcel No. 317-031-56).
That the City Clerk of the City of Poway is hereby
directed to cause a certified copy of this resolution
to be recorded in the office of the County Recorder.
PASSED AND ADOPTED by the City Council of the City of Poway,
California, at a regular meeting thereof this 22nd day of May, 1984.
