A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF POWAY, SAN DIEGO COUNTY,
CALIFORNIA, DECLARING THE INTENTION
TO LEVY AND COLLECT
ASSESSMENTS WITHIN THE
POWAY LANDSCAPE MAINTENANCE ASSESSMENT
DISTRICT NO. 83-1 FOR FISCAL YEAR 1984-5
WHEREAS, the City Council of the City of Poway,
California, desires to levy and collect assessments within
Poway Landscape Maintenance Assessment District No. 83-1
for the purposes of maintaining, servicing and operating
public landscape facilities located within the territory
comprising said District as shown in Exhibit "A", pursuant
to the Landscape and Lighting Act of 1972; and
WHEREAS, the public interest and convenience require
the maintenance, service and operation of the public
landscaping, sound walls, recreational trails and future
parks within said territory.
NOW, THEREFORE, the City Council of the City of Poway
does hereby resolve as follows:
1. The foregoing recitals are true and correct and
the City Council so finds and determines.

Proposed assessments for 1984-5 are as detailed
in the "Engineer's Report for Poway Landscape
Maintenance Assessment District No. 83-1 for
1984-5 Fiscal Year". Exhibit "B"
Pursuant to the Streets and Highway Code, a
public hearing will be held on July 24, 1984 in
the City Council Chamber of City Hall to consider
the levy and collection of the proposed assessments.
PASSED, APPROVED AND ADOPTED at a regular meeting this
26th day of June, 1984.

ENGINEER'S REPORT
FOR POWAY
LANDSCAPE MAINTENANCE ASSESSMENT DISTRICT NO. 83-1
FOR 1984-5 FISCAL YEAR
PURPOSE
The purpose of this report is to set forth findings and engineering
analysis for the Poway Landscape Maintenance Assessment District No. 83-1
for 1984-5 fiscal year. The Assessment District was formed June 14, 1983
as a means of financing the maintenance of landscape improvements installed
in conjunction with new subdivisions in Poway, the boundary being as shown
in Exhibit A.
FINDINGS
The Landscaping and Lighting Act of 1972 permits the establishment of
assessment districts by cities for the purpose of providing for the maintenance
of certain public improvements which includes the facilities existing within
the subject assessment district. The 1972. Act 'requires that maintenance
assessments be levied according to benefit rather than according to estimated
value. Section 22573 provides that:
"The net amount to be assessed'~upon lands within an assessment
district may be apportioned by any formula or method which fairly
distributes the net amount among all assessable lots or parcels
.in proportion to the estimated benefit to be received by each
such lot or parcel from the improvements."
Based upon the foregoing, it is proposed the City of Poway generate the
necessary revenue required to maintain the aforementioned landscaping improve-
ments with Landscape Maintenance Assessment District No. 83-1 for the 1984-5
fiscal year using the method provided for in the Landscape and Lighting Act
of 1972.
ENGINEERING ANALYSIS
Boundary
The boundary of the proposed assessment district is as shown on Exhibit A
with Rancho Arbolitos being considered a 975 lot subdivision when calculating
assessments. The district boundaries are included in the district, excepting
from the assessment of said costs and expenses within the area described,
the area of all public streets, public avenues, public lanes, public roads,

public drives, public courts, public alleys, all easements and right of ways,
all public parks, greenbelts and parkways, and all public school property
being used for public school purposes.
NAME
The District is entitled the "Poway Landscape Maintenance Assessment District
No. 83-1."
FACILITIES
The facilities to be maintained are defined as the landscaping and sound walls
within the right of way of and adjacent to, Camino del Norte, Pomerado Road,
and future Route 56; the recreational trails and greenbelts within the District
boundaries and 25% of the maintenance costs of all future parks within the
District.
BENEFIT ANALYSIS
The District is made up of five subdivisions: Poway Woods Unit 1, 55 lots,
Poway Woods Unit 2, 57 lots; Casa.Real Unit 7, 68 lots; The Colonies of Poway,
30 lots; and Rancho Arbolitos, 975 potential lots; for a total of 1,185 lots.
The-assessments will be calculated.on a per lot basis by dividing the total
budget by 1,185.
Since the two proposed parks have not been developed and only a portion of
the landscaping and sound walls will be accepted for maintenance in 1984-5,
the maintenance budget will remain low in 1984-5.
