The Assessment District was formed June 14, 1983 as a means of financing the maintenance of landscape improvements installed in conjunction with new subdivisions in Poway, the boundary being as shown in Exhibit A. FINDINGS The Landscaping and Lighting Act of 1972 permits the establishment of assessment districts by cities for the purpose of providing for the maintenance of certain public improvements which includes the facilities existing within the subject assessment district. The 1972. Act 'requires that maintenance assessments be levied according to benefit rather than according to estimated value. Section 22573 provides that: "The net amount to be assessed'~upon lands within an assessment district may be apportioned by any formula or method which fairly distributes the net amount among all assessable lots or parcels .in proportion to the estimated benefit to be received by each such lot or parcel from the improvements." Based upon the foregoing, it is proposed the City of Poway generate the necessary revenue required to maintain the aforementioned landscaping improve- ments with Landscape Maintenance Assessment District No. 83-1 for the 1984-5 fiscal year using the method provided for in the Landscape and Lighting Act of 1972. ENGINEERING ANALYSIS Boundary The boundary of the proposed assessment district is as shown on Exhibit A with Rancho Arbolitos being considered a 975 lot subdivision when calculating assessments. The district boundaries are included in the district, excepting from the assessment of said costs and expenses within the area described, the area of all public streets, public avenues, public lanes, public roads, Exhibit B to Resolution No. Page 1 of 3 84-056 -2- public drives, public courts, public alleys, all easements and right of ways, all public parks, greenbelts and parkways, and all public school property being used for public school purposes. NAME The District is entitled the "Poway Landscape Maintenance Assessment District No. 83-1." FACILITIES The facilities to be maintained are defined as the landscaping and sound walls within the right of way of and adjacent to, Camino del Norte, Pomerado Road, and future Route 56; the recreational trails and greenbelts within the District boundaries and 25% of the maintenance costs of all future parks within the District. BENEFIT ANALYSIS The District is made up of five subdivisions: Poway Woods Unit 1, 55 lots, Poway Woods Unit 2, 57 lots; Casa.Real Unit 7, 68 lots; The Colonies of Poway, 30 lots; and Rancho Arbolitos, 975 potential lots; for a total of 1,185 lots. The-assessments will be calculated.on a per lot basis by dividing the total budget by 1,185. Since the two proposed parks have not been developed and only a portion of the landscaping and sound walls will be accepted for maintenance in 1984-5, the maintenance budget will remain low in 1984-5. PROPOSED 1984-5 BUDGET Engineering, Administration, and Legal .... $ 3,000 Contractual Services ............. 16,400 utilities (water, electricity) ........ 3,000 Contingency ................. 1,000 TOTAL $23,400 -3- REVENUE S Cash Carryover ...... $11,550 1984-5 Assessment ..... 11,850 TOTAL $23,400 ASSESSMENT It is determined that all units benefit equally. Accordingly, the assessments for each lot or prospective lot is: Budget _ $11,850 # Lots 1,185= $10 per lot Respectfully submitted, Alan D. Archibald, p. E.
