A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA,
ADOPTING FIbDINGS OF LOCAL CObDITIONS
PRIOR TO ~:,'~'ECTIVE DATE OF ORDINANCE NO. 131
WHEREAS, the City Council of the City of Poway has adopted ordinance No.
131 to become effective August 9, 1984; and
~REAS, Ordinance No. 131 incorporates certain local changes and modifica-
tions in the requirements contained in the Uniform Fire Code and the Uniform
Building Code; and
~EREAS, California Health and Safety Code Section 17958.7 requires that
where a local ordinance :incorporates such changes and modifications, the
governing body of the city shall make an express finding that such changes and
modifications are nc~ed and shall file such finding with the Department of
Housing and C~,,L~nity Development prior to such change or modification becoming
effective; and
~tEREAS, California Health and Safety Code Section 17958.5 provides that
such changes and modifications shall be found to be reasonably necessary because
of local climatic, geographical, or topographical conditions.
TMRREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PO~AY AS
The changes and modifications in the requirements of the Uniform Fire
Code and the Uniform Building Code set forth in Ordinance NO. 131 of
the City of Poway, to become effective August 9, 1984, are reasonably
necessary because of the following climatic, geographical, and
topographical conditions:
a. The City is approximately 37 square miles in size and is situated
in hilly, inland terrain. Approximately 55% of the area of the
City is "wildland" for fire purposes and is covered by native
vegetation on often steep and frequently inaccessible hillsides.
b. The native ground cover is highly cc~bustible dense brush, grasses
and chapparal. Natural firebreaks within the wildland areas of
the City are .insignificant.
c. The climate is warm and dry. The winds prevail frcm the west.
Seasonal strong dry east winds are variable in both duration and
intensity. The impact of such winds upon wildland fires is to
enlarge the burn area also causing abrupt and unpredictable change
in fire direction. T~eratures ranging between 85° and 100° F.
are cc~on throughout much of the year.

d. For the above climate, geographical and topographical reasons, the
potential for fire damage, in the event that wildland area is
ignited, is great in that such a fire can spread rapidly and fire
department response time is slowed by difficult terrain and
vegetation.
e. The above cited topographical conditions further dictate a rural
road syst~m~ providing narrow, winding rcadw~ys, often of grades in
excess of that necessary for optimal response time for large fire
apparatus.
f. The above cited geographical conditions further dictate a likeli-
hood of substantial distance bet~cn the nearer of two City fire
stations and the fire site, an additional factor slowing response
time.
For all of the above cited reasons, it is reasonable and necessary to reduce
the City's unusually high fire potential by the implementation of the
modifications and changes to the Building and Fire Code set forth in
ordinance No. 131. By the adoption of said modifications and changes both
the likelihood that structural fires will ignite wildland areas and the
likelihood of loss of structures in wildland fires will be reduced.

This Resolution shall be effective AUC~ast 7, 1984.
The City Clerk is authorized and directed to file a copy of this
Resolution and a copy of ordinance No. 131 with the Department of
Housing and C~L~aunity Develo~Nent on or before August 9, 1984, the
effective date of Ordinance NO. 131.
