A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY,
CALIFORNIA, STATING ITS INTENTION TO VACATE AND ABANDON
A PORTION OF A WATER LINE AND UTILITY EASEMENT,
LOCATED NEAR TWIN PEAKS ROAD, AT SILVERSET STREET,
AND SETTING A PUBLIC HEARING DATE
(VACATION NO. 84-05)
WHEREAS,there has been requested the vacation of the here-
inafter described easement, and
WHEREAS, Chapter 3 of Part 3 of Division 9 of the State of
California Streets and Highways Code, commencing at Section 8320,
provides that the City Council may, by resolution, declare its
intention to vacate any public service easement, and
WHEREAS, a public hearing is required at which all interested
parties may give evidence and testimony as to whether the herein-
after described easement is necessary for any present or prospective
public use and if it should or should not be vacated.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Poway that it is the intention of this Council to vacate
and abandon the City water line and utility easement, described
in Exhibit A, which is attached hereto and made a part hereof,
pursuant to the procedures prescribed in Chapter 3, Part 3,
Division 9 of the Streets and Highways Code.
IT IS ORDERED that Tuesday, November 20, 1984, at the hour of
7 p.m. at City Hall Council Chambers, 13325 Civic Center Drive, is
fixed as the time and place for a public hearing on this matter.
IT IS FURTHER ORDERED THAT THE City Clerk of this City give
notice of the adoption of this resolution and of the time and
place fixed for the hearing by publication of a notice therefor
in the "Poway Chieftain", a newspaper of general circulation
published in the County of San Diego, for at least two successive
weeks prior to said day fixed for said hearing, and that the Clerk
also cause similar notices to be conspicuously posted along the
pipe line easement proposed to be vacated as above described.
PASSED AND ADOPTED by the City Council of the City of Poway,
California at a regular meeting thereof this 23rd day of
October , 1984.
