A RESOLUTION CF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA,
VACATING A PIPELINE EASEMENT WITHIN
UNIT 1 OF TENTATIVE TRACT TM 4113,
AT TWIN PEAKS ROAD AND SILVERSET STPa~'l'
VACATION NO. VAC 84-05

WHEREAS, there has been requested the vacation of the hereinafter described
pipeline easement, and
WHEREAS, on October 23, 1984, the City Council of the City of Poway declared
its intention to vacate the said street easement by its passage of City Council
Resolution No. 84-108, and
WHEREAS, on November 20, 1984, a duly advertised and posted public hearing
was held on the vacation request,
NOW .T~R. REFORE, BE IT RESOLVED, by the City Council of the City of Pcway as
follows:
City Council hereby finds that:
a. There were no written or oral objections or protests to the said
vacation.
b. The pipeline easement to be vacated has no other present or
prospective public bikeway, equestrian, or pedestrian trail
facility.
c. The pipeline eas~nt vacation will not have a significant effect
upon theenvironment.
Pursuant to Chapter 3 of Part 3 of Division 9 of the State Streets and
Highways Code, the waterline easement described in Exhibit A, which is
attache@ to and madea part hereof, is hereby vacatedand abandoned.
That the City Clerk of the City of Pow-ay is hereby directed to cause a
certified copy of this resolution to be recorded in the Office of the
County Recorder.
PASSED, ADOPTED AND APPROVED, by the City Council of the City of Poway,
California, at a regular meeting thereof this 20th day of November, 1984.
