A RESOLUPION CF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA,
DECLARING THAT THE PUBLIC INTEREST AND
h~]C?.qSITY DEMAND THE ~IATE E~PEhI)ITURE
OF FUNDS AND AUTHORIZING SUCH EXPENDITURE
WHEREAS, California Public Contract Code Section 20168 provides that
cc~liance with the bidding requirements of the Local Agency Public Construction
Act shall be legally excused upon adoption by the City Council of a resolution
by four-fifths votes of its members declaring tb~t the public interest and
necessity demand the inm~iate expenditure of public money to safeguard life,
health, or property; and
WHEREAS, the traffic signal control box which controls vehicular and
pedestrian traffic at the intersection of Poway Road and Carriage Road in Poway,
California has been destroyed in a traffic accident; and
WHEREAS, the City Council of the City of Poway finds that the destruction of
said control box constitutes a great public calamity and that the ~%~diate
expenditure of public money is necessary to replace said control box in order to
safe.rural the life, health, and property of persons using said intersection.
NOW, THEREFORE, ~E IT RESOLVED:
1. The City Council of the City of Poway hereby declares that the public
interest and necessity demand the i~mediate expenditure of public money
for the replacement of the traffic signal control box at the intersec-
tion of Poway Road and Carriage Road in Poway, California, in order
that vehicular and pedestrian traffic be safely controlled at said
intersection.
2. The City Council of the City of Poway does hereby authorize the expen-
diture a sum not to exc~-~cd $15,000 to Southwest Signal Service to
replace and repair said control box.
