Res 84-121RESOLUTION NO. 84-121 A Rw-qOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA, ORDERING S~Y VACATION OF THE ~F~ST HALF OF THE SOUTHEAST QLI~RTER, SECTION 25, T13S, R2W, SBM (APN 275-460-10, 11, 12 and 13) C~RN vAr,r,RY CONV~T.~ WHEREAS, the City Council has been requested to vacate a portion of property located in the west half of the southeast quarter, Section 25, T13S, R2W, SBM which is no longer required by the City of Poway for public use purposes; and WfIEREAS, said vacation is consistent with the general plan of the City of Pow-ay; and h~REAS, said property is not useful as a nom~otorized transportation facility. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PO~AY AS FO~: The City Council finds that the portion of property hereinafter described, located in the west half of the southeast quarter, Section 25, T13S, R2W, SBM, and previously dedicated for water lines and appur- tenances eas~nent purposes, is found to be unnecessary for present or future public use purposes. There are no in-place public utility faci- lities that are in use or would be affected Dy the vacation. Pursuant to Section 8333(a) and (c) of the Strccts and Highways Code, said ease- ment may be sunmarily vacated. (a) The easement has not ~cn used for the purpose for which it was dedicated or acquired for five consecutive years inmediately pre- ceeding the proposed vacation. (c) The easement has been superceeded by relocating and there are no other public facilities located within the easement. Therefore, the City Council hereby orders the sunmary vacation of the following described property, pursuant to the provisions of Chapter 4 of the Public Streets, Highways, and Service Easements Vacation Law, Section 8330 et seq. of the Streets and Highways Code of the State of California. Resolution No. 84-121 Page 2 See Exhibits A and B attached hereto and made a part hereof. All as more particularly shown on a plat on file in the office of the City Clerk of the City of Poway. 2. Frc~ and after the date this Resolution is recorded, said property herein vacated shall no longer constitute a public service (water lines and appurtenances ) easement. 3. The City Clerk is directed to cause a certified copy of this Resolution to be recorded in the office of the County Recorder of San Diego County.
