A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
AMENDING THE LAND USE ELEMENT OF
THE GENERAL PLAN OF THE CITY OF POWAY
COMPREHENSIVE PLAN (GPA 84-03D)
WHEREAS, the City Council of the City of Poway recognizes that
the need may arise to amend the City's General Plan; and
WHEREAS, Section 65350, et seq., of the California Geovernment
Code describes the procedures for amending General Plans; and
WHEREAS, the City Council of the City of Poway directed a review
of the land use designation on two (2) parcels having a combined
area of approximately 4.44 acres and located on the west side of
Community Road, south of its intersection with Hilleary Place
(APN 317-101-24 and 27);
WHEREAS, the City of Poway held a properly noticed public hearing
in accordance with the California Government Code and the California
Environmental Quality Act to consider that request;
WHEREAS, the City Council of the City of Poway finds that Policy
3b. of the Flood Hazard Element of the Comprehensive Plan which
states that undeveloped or vacant land within the 100-year
floodplain should be designated for rural residential or open
space uses, applies to these properties.
NOW THEREFORE, BE IT RESOLVED that the City Council does hereby
amend the General Plan Land Use Map for the westerly parcel (APN
317-101-27) from Residential Apartment to Residential Rural C
for those portions of the property which lie in the floodway and
floodplain for Rattlesnake Creek.
WHEREAS, the City Council of the City of Poway finds that Policy
3b. of the Flood Hazard Element has been satisfied for the easterly
parcel (APN 317-101-24) as a result of the previous issuance of a
stock pile permit removing that parcel from the floodplain.
PASSED and ADOPTED by the City Council of the City of Poway,
