A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
AMENDING THE COMMUNITY DESIGN ELEMENT OF
THE GENERAL PLAN OF THE CITY OF POWAY
COMPREHENSIVE PLAN (GPA 84-03J)
WHEREAS, the City Council of the City of Poway recognizes that
the need may arise to amend the City's General Plan; and
WHEREAS, Section 65350, et seq., of the California Government
Code describes the procedures for amending General Plans; and
WHEREAS, in certain situations where parcels of land have non-
uniform slopes, the existing policies (16.c and 16.d) in the
Community Design Element related to Hillside Residential Design may
not be achieving the desired use of multiple foundations to reduce
grading impacts;
WHEREAS, the City of Poway held a properly noticed public hearing
in accordance with the California Government Code and the California
Environmental Quality Act to consider that request; and
WHEREAS, the City Council of the City of Poway finds that the
protection of hillside areas from significant alteration as required
in the City's Comprehensive Plan requires a modification of policies
related to Hillside Residential Design.
NOW THEREFORE, BE IT RESOLVED that the City Council does hereby
amend the General Plan Community Design Element, Policies 16.c and
16.d for Hillside Residential Design as follows:
Policy 16.c Where construction is proposed on those portions of
lots where the slope is greater than 15 percent, the use of
custom homes with multiple foundation levels is encouraged.
Policy 16.d Where construction is proposed on those portions of
lots where the slope is greater than 25 percent, the use of
custom homes with multiple foundation levels is required.
PASSED and ADOPTED by the City Council of the City of Poway,
State of California this 18th day of December.
