Res 85-004RESOLUTION NO. 85-004 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA GRANTING A SECOND NINETY (90) DAYS FOR DEMOLITION OF THE APARTMENT BUILDING AT 12347 POMERADO ROAD WHEREAS, on April 17, 1984 the City Council of the City of Poway determined that the apartment building located at 12347 Pomerado Road was unsafe, substandard, and a public nuisance; WHEREAS, the City Council ordered that the unsafe and substandard conditions be corrected or the building demolished by the property owner by October 17, 1984; WHEREAS, the unsafe building has been vacated and electrical service has been discontinued; WHEREAS, the property owners were in the process of preparing a development feasibility study for a new apartment project on the site and requested on October 16, 1984 that the time for demolition of the unsafe building be extended by the City Council to coincide with site preparation for the new project; WHEREAS, the City Council granted a ninety (90) day extension for demolition of the unsafe building on October 16, 1984; WHEREAS, the property owners have diligently progressed in preparation of the development plans for the new apartment project and the application for Development Review can be submitted within sixty (60) days; and WHEREAS, the property owners have begun installing six (6) foot high chainlink fence with locked gate around the unsafe building as a step toward it demolition. NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Poway as follows: 1. The City Council hereby grants an extension of time of ninety (90) days to April 17, 1985, for the property owners to demolish the building as described in Resolution P 84-22, subject to the following conditions: Se A Development Review application for a new apartment project shall be submitted to the Planning Services Department by March 15, 1985. Resolution 85-004 Page 2 o be A six (6) foot high chainlink fence with locked gate shall be completely erected around the existing building by January 30, 1985. Ce A security mechanism and written agreement acceptable to the City Attorney to insure removal of the existing building at the end of the ninety (90) day extension shall be provided by the property owners by February 28, 1985. The City Council shall be advised immediately should the property owners fail to meet the conditions specified above and the matter shall be scheduled before the City Council to consider City removal of the unsafe building.
