AN ORDINANCE OF THE CITY OF POWAY, CALIFORNIA
DELETING DIVISION 3, SS33.101, et seq. OF THE CITY
OF POWAY REGULATORY ORDINANCES AND ESTABLISHING
PROHIBITIONS FOR THE DISCHARGE OF FIREARMS
THE CITY COUNCIL OF THE CITY OF POWAY DOES ORDAIN AS FOLLOWS:
Section 1. The City Council finds that large areas of the City of Poway are
sparsely PoPulated and used for the discharge of firearms. Tnese areas are also
used as farmland, horseback riding areas and for other recreational activities
by the citizens of this City. The City Council finds that the discharge of
firearms within the City is a use incomparable with other uses made of said
lands.
Section 2. Division 3, S~33.101 through 33.109 of the City of Poway
Regulatory Ordinances are hereby deleted. Division 3 at S33.101 shall hereafter
read as follows:

Firearm and Explosive Regulation
Section 33.101
Definitions. For the purPoses of this section:
Firearm shall mean any device or weapon from which a missile, such
as, but not limited to, a bullet, ball or shell, is hurled by
compressed air or explosive.
Fire shall mean to explode, discharge or impel by using compressed
air, heat, percussion or electric spark.
The term "explosive" is defined as any chemical compound or any
mechanical mixture when ignited by fire, friction, concussion,
percussion, detonator or any other means causes a sudden or rapid
combustion, causing violent expansion of the air or gases and
accompanied by a report.
b. Prohibition. No person shall fire any firearm or explode any
explosive within the City of Poway.
c. Exceptions. This section does not apply to firearms fired under
the authority of the United States, the State of California, or the
City of Poway, nor to shooting galleries or target ranges; nor where a
permit has been issued or a firing area designated by the City Council
pursuant to Subsections (d) and (e) hereof.

d. Permits. The City Council, by resolution, may issue written
permits to fire firearms or explode explosives upon such terms and
under such conditions as it deems proper. The terms and conditions
imposed by the Council shall be set forth on the face of any permit
issued under this subsection.
e. The City Council, by resolution, may designate certain areas within
the City in which it shall be lawful to fire firearms upon such terms
and under such conditions as the Council deems proper.
Introduced and first read at a regular meeting of the City Council of the
City of Poway held the 16th day of June, 1981, and thereafter PASSED, AND
ADOPTED at a regular meeting of said City Council held the 23rd day of June,
1981 by the following vote:
