Res 85-031RESOLUTION NO. 85-031 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA, DECLARING THE INTENTION TO LEVY AND COLLECT ASSESSMENTS WITHIN THE POWAY LANDSCAPE MAINTENANCE ASSESSMENT DISTRICT NO. 83-1 FOR FISCAL YEAR 1985-86 WHEREAS, the City Council of the City of Poway, California desires to levy and collect assessments within Poway Landscape Maintenance Assessment District No. 83-1 for the purposes of maintaining, servicing and operating public landscape facilities located within the territory comprising said district as shown in Exhibit "A", pursuant to the Landscape and Lighting Act of 1972; and WHEREAS, the public interest and convenience requires the maintenance, service and operation of the public landscaping, soundwalls, recreational trails, and future parks within said territory. NOW THEREFORE, the City Council of the City of Poway does hereby resolve as follows: 1. The foregoing recitals are true and correct and the City Council so finds and determines. 2. Proposed assessments for 1985-86 are as detailed in the "Engineer's Report" for Poway Landscape Maintenance Assessment District No. 83-1 for 1985-86 fiscal year, Exhibit "B". 3. Pursuant to the Streets and Highway Code, a public hearing will be held on June 4, 1985 in the City Council Chambers at City Hall to con- sider the levy and collection of the proposed assessments. 1 4th PASSED, ADOPTED, and APPROVED at a regular meeting this day of May, 1985. I ADOBE RIDGE CASA REAL ANCHO I&ll UNIT 7 ARBOLITOS TWIN PEAKS ROAD THE COLC NO SCALE PROPOSED COMMERCIAL AREA NOTE: ADOBE RIDGE (FORMERLY POWAY WOODS) THE COLONIES (FORMERLY POWAY HILLS) RANCHO ARBOLITOS RESOLUTION NO. 85-031 EXHIBIT B ENGINEER'S REPORT FOR POWAY LANDSCAPE MAINTENANCE ASSESSMENT DISTRICT NO. 83-1 FOR 1985-86 FISCAL YEAR PURPOSE The purpose of this report is to set forth findings and engineering analysis for the Poway Landscape Maintenance Assessment District No. 83-1 for 1985-86 fiscal year. The Assessment District was formed June 14, 1983 as a means of financing the maintenance of landscape improvements installed in conjunction with new subdivisions in Poway, the boundary being as shown in Exhibit A. FINDINGS The Landscaping and Lighting Act of 1972 permits the establishment of assessment districts by cities for the purpose of providing for the maintenance of certain public improvements which includes the facilities existing within the subject assessment district. The 1972 Act requires that maintenance assessments be levied according to benefit rather than according to estimated value. Section 22573 provides that: "The net amount to be assessed upon lands within an assessment district may be apportioned by any formula or method which fairly distributes the net amount among all assessable lots or parcels in proportion to the estimated benefit to be received by each such lot or parcel from the improvements." Based upon the foregoing, it is proposed the City of Poway generate the necessary revenue required to maintain the aforementioned landscaping improvements with Landscape Maintenance Assessment District No. 83-1 for the 1985-86 fiscal year using the method provided for in the Landscape and Lighting Act of 1972. -1- ENGINEERING ANALYSIS Boundary The boundary of the proposed assessment district is as shown in Exhibit A with Rancho Arbolitos subdivision being the major portion of the district with 975 lots. The other component subdivisions presently making up the District are Adobe Ridge I and II (formerly Poway Woods 1 and 2), the Colonies (formerly Poway Hills), and Casa Real Unit 7. A small number of parcels that are zoned commercial are subject to inclusion within the District when they are developed. The prospective commercial areas are shown on Exhibit A. The district boundaries are included in the district, excepting from the assessment of said costs and ex- penses within the area described, the area of all public streets, public avenues, public lanes, public roads, public arives, public courts, public alleys, all easements and rights of way, all public parks, greenbelts and parkways, and all public school property being used for public school purposes. NAME The District is entitled the "Poway Landscape Maintenance Assessment District No. 83-1." FACILITIES The facilities to be maintained are defined as the landscaping and soundwalls within the right of way and adjacent to Camino del Norte, Twin Peaks Road, Pomerado Road, and future Route 56; the recreational trails side- walks, and greenbelts within the District boundaries and 25% of the maintenance costs of all future parks within the District. EXISTING CONDITIONS OF LANDSCAPE MAINTENANCE WITH DEVELOPED SUBDIVISIONS OF DISTRICT A general assessment of the present level and quality of landscape maintenance within subdivisions of the District having improved landscape development within public right of way has been recently conducted. Numerous deficiencies in plant care, weed control, and irrigation systems were found. Each of the respective subdivisions will again be inventoried and evaluated to insure compliance with requested improvements to landscape maintenance prior to City acceptance of said developed areas into the Assessment District. Landscape maintenance and performance standards and specifications are currently being developed to assure a level of consistency and quality to landscape care of assessment district properties upon City acceptance. -2- COMMERCIAL PROPERTIES PROPOSED FOR INCLUSION INTO DISTRICT In the immediate future, certain properties proposed for commercial development (see Exhibit A) will require portions of these properties within the public right of way to be included within the Assessment District. Currently, there is no landscape development on the properties. A concern of the City is how these properties will develop the public portion of their respective landscape areas and to what intensity. Typically, commercial properties will be larger lot sizes and consequently have a higher degree of landscape improvements along the street edges bounding the commercial centers. Both market imag.e and overall concern for attractiveness of the developed commercial site contribute to a greater level of landscape enhancements in some cases. A potential does exist for the need to provide a differential assessment to commercial properties than residential properties within the District. To provide some measure of uniformity in determination of future assessments to commercial properties within the District, the City should consider working with the respective owners of such properties to establish master landscape development criteria. An effort such as this could result in a general landscape development plan, specific to the commercial core, that would yield a ~ consistent level of landscape development for said properties, provide a measure of visible unity to the overall landscape image of the District, and most ~mportantly, allow for the establishment of an equitable assessment. BENEFIT ANALYSIS The District is made up of five subdivisions: Adobe Ridge Unit 1, 55 lots and Adobe Ridge Unit 2, 57 lots (formerly Poway Woods); Casa Real Unit 7, 68 lots; The Colonies of Poway, 30 lots (formerly Poway Hills); and Rancho Arbolitos, 975 potential lots; for a total of 1,185 lots. The assessments will be calculated on a per lot basis by dividing the total budget by 1,185. -3- Proposed FY 85-86 Budget for Landscape Maintenance Assessment District 83-1 Item 1. As discussed, the possibility of future inclusion of commer- cial properties would be cause for differential assessment to commercial centers dependent upon how landscape develop- ment of said properties within the District is carried out.
