A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY,
CALIFORNIA RATIFYING THE TRANSFER OF FIRE STATION 3 FROM
THE POWAY REDEVELOPMENT AGENCY TO THE CITY OF POWAY
FOR MUNICIPAL PURPOSES
WHEREAS, the City Council of the City of Poway (the "City Council ") adopted the
Redevelopment Plan for the Paguay Redevelopment Project Area (the "Project Area ")
on December 13, 1983 by Ordinance No. 117, as amended by Ordinance No. 415 on
June 15, 1993, Ordinance No. 439 on December 13, 1994, Ordinance No. 593 on
December 2, 2003, Ordinance No. 605 on August 17, 2004, Ordinance No. 611 on
October 26, 2004, Ordinance No. 641 on July 18, 2006, and Ordinance No. 657 on
June 12, 2007 (the- "Redevelopment Plan "); and
WHEREAS, the Poway Redevelopment Agency (the "Agency') previously
acquired certain real property in the Project Area identified as Assessor's Parcel
Number 314 - 040 -25 (the "Property "); and
WHEREAS, it was the intent of the Agency and the City of Poway (the "City ") that
the Property be conveyed to the City for construction and operation of a City fire station;
and
WHEREAS, Fire Station 3 was since constructed and has been continuously
operating on the Property but the conveyance of the Property to the City was not
effectuated; and
WHEREAS, on March 11, 2011, the Redevelopment Agency conveyed the
Property to the City in furtherance of the intent of the Agency and the City.
NOW, THEREFORE, the City Council of the City of Poway does hereby resolve
as follows:
Section 1. The City Council hereby finds and determines that the foregoing
recitals are true and correct.
Section 2. The City Council hereby approves, accepts and ratifies the transfer
of the Property to the City for use by the City as a fire station or for other municipal
purposes to benefit the Project Area
Section 3. The City Manager or designee is hereby authorized to take all
additional reasonable and necessary actions and sign on behalf of the City all additional
reasonable and necessary documents first approved in writing by the City Attorney to
implement and carry out the transfer of the Property from the Redevelopment Agency to
the City.
Section 4. The City Council ratifies and approves the City Clerk's execution of
the Certificate of Acceptance of the transfer of the Property from the Agency to the City.

Section 5. This Resolution shall take effect immediately upon its adoption.
PASSED, ADOPTED AND APPROVED by the City Council of the City of Poway
at a regular meeting this 15th day of March, 2011.
