AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA,
APPROVING SPECIFIC PLAN AMENDMENT (SPA) 84-01XX, SPA 84-0IEEE, SPA
84-01GGG, AND SPA 84-01HHH TO THE SOUTH POWAY SPECIFIC PLAN TO
CHANGE THE LAND USE DESIGNATION OF CERTAIN PROPERTIES FROM
LIGHT INDUSTRIAL TO INDUSTRIAL PARK

317-271-01,06, 07, 12, 13, 18, 50, AND 52 THROUGH 55;
317-224-21; AND 317-224-02 THROUGH 04.
WHEREAS, Specific Plan Amendment (SPA) 84-01XX was submitted by Tech
Business Center, LLC, SPA 84-01 was submitted by RL Holdings, LLC, SPA 84-01GGG
was submitted by Tech Business Center, LLC, and SPA 84-01HHH was submitted by
Pomerado Properties LP to the City for consideration; and
WHEREAS, Chapter 17.47 (Specific Plan Regulations) of Title 17 (Zoning
Development Code) of the Poway Municipal Code provides the requirements for the
initiation, preparation and adoption of Specific Plans in accordance with Section 65450,
et seq. of the California Government Code (Article 8, Specific Plan); and
WHEREAS, Section 17.47.020.C (Initiation) of the Zoning Development Code
provides that the City Council may initiate the preparation of, or amendment to, a
Specific Plan on property by Resolution; and
WHEREAS, on October 22, 2002, the City Council initiated SPA 84-01XX, SPA
84-0IEEE, SPA 84-01GGG, and SPA 84-01HHH by Resolution; and
WHEREAS, SPA 84-01XX, SPA 84-0IEEE, SPA 84-01GGG, and SPA 84-
01HHH involve a combined total of 45.8 acres of property in the South Poway Business
Park and a request to change the land use designation of those properties from Light
Industrial to Industrial Park; and
WHEREAS, on December 17, 2002, the City Council held a duly advertised
public hearing to solicit comments from the public, both pro and con, relative to this
application.
NOW, THEREFORE, the City Council does hereby ordain as follows:
Section 1: The City Council finds that the proposed project has been adequately
addressed in, and is within the scope of, the Negative Declaration (ND) approved for
SPA 84-01QQ on July 17, 2001 and, therefore, no additional environmental review or
notice is necessary.

Section 2: The City Council makes the following findings in approving SPA 84-01XX,
SPA 84-0IEEE, SPA 84-01GGG, and SPA 84-01HHH:
A. The change in land use designation will not result in an over concentration of
any one particular type of land use that would have a negative affect on the
overall economy of the City in that there is a high demand for office space in the
South Poway Business Park.
B. The uses proposed with the land use designation change will promote high
standards of site planning, architecture and landscape design in that all
development projects have been, or will be, designed to comply with the design
standard of the South Poway Specific Plan.
Section 3: The City Council hereby approves SPA 84-01XX, SPA 84-0IEEE, SPA
84-01GGG, and SPA 84-01HHH and an amendment to the Land Use Plan as adopted
pursuant to SPA 84-01 DDD as follows:
A. Pursuant to SPA 84-01XX, the land use designation on the seven contiguous
properties, totaling 32.54 acres, located at the southerly terminus of Community
Road and as shown in Exhibit A attached to this Ordinance is hereby changed
from Light Industrial to Industrial Park subject to the payment of traffic impact
mitigation fees totaling $127,068 to be paid (on a pro rata basis) prior to the
issuance of any building permit on the subject properties.
B. Pursuant to SPA 84-01EEE the land use designation on the 1.4-acre property
located at 13975 Danielson Street and as shown in Exhibit B attached to this
Ordinance is hereby changed from Light Industrial to Industrial Park subject to
the payment of traffic impact mitigation fees totaling $5,467 to be paid prior to the
issuance of any building permit on the subject property.
C. Pursuant to SPA 84-01GGG the land use designation on the eleven properties,
totaling 7.35 acres, located at the northerly terminus of Dearborn Place, Flint
Place, and Paine Place and as shown in Exhibit C attached to this Ordinance is
hereby changed from Light Industrial to Industrial Park subject to the payment of
traffic impact mitigation fees totaling $28,701 to be paid (on a pro rata basis) prior
to the issuance of any building permit on the subject properties.
D. Pursuant to SPA 84-01HHH the land use designation on the four properties
totaling 4.54 acres located on Brookprinter Place and as shown in Exhibit D
attached to this Ordinance is hereby changed from Light Industrial to Industrial
Park subject to the payment of traffic impact mitigation fees totaling $17,728 to
be paid (on a pro rata basis) prior to the issuance of any building permit on the
subject properties.

EFFECTIVE DATE: This Ordinance shall take effect and be in force thirty (30)
days after the date of this passage; and before the expiration of fifteen (15) days after
its passage, it shall be published once with the names and members voting for and
against the same in the Poway News Chieftain, a newspaper of general circulation
published in the City of Poway.
Introduced and first read at a regular meeting of the City Council of the City of
Poway held this 17th day of December 2002 and thereafter PASSED AND ADOPTED
at a regular meeting of said City Council held the 7th day of January 2003, by the
following roll call vote.
