The real property located in the City of Poway, County of San Diego, State of California,
described as follows:

The City Manager's designee has determined that the property having the above address
and APN is in violation of the Conditions of Approval of Minor Development Review
Application 08 -48WCF for the property. Specifically the following conditions:
1. Remove and relocate the drainage improvements, installed without City approval
on the subject site in September 2008, to observe 'a minimum 25 -foot setback from
the creek bank as shown on the approved project grading plan. Areas impacted
by the non- permitted drainage installation must be returned to the original site
conditions upon relocation of the drainage improvements.
2. All disturbed 'slopes of greater than 5:1 shall be planted, and irrigated in accordance
with the approved Brush Management Plan. A variety of landscaping, including
trees, shrubs and ground cover, shall be installed on the slopes to ensure stability.
Groundcover shall be hydroseeded or hand - planted cuttings appropriately spaced
to eventually control soil erosion. The new, 1- gallon oak trees shall be installed
pursuant to the approved Brush Management Plan.
3. The illegal fill material placed around the base of the trunks of the oak trees
- identified, on the project Brush Management Plan must be cleared to native grade

at least five feet from the base of the tree trunks. Short retaining walls shall be
installed as needed to hold back soil.
4. Record drawings, signed by the engineer of work, shall be submitted to
Development Services for review and approval, per Section 16.52.1306 of the
Grading Ordinance.
Failure to complete the above - listed conditions.is in violation of the
Poway Municipal Code Section 17.52.090.D
The record owner of the Property has been duly notified and given an opportunity to correct
the violation.
