A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA,
ORDERING THE VACATION OF THE WATERLINE EASEMENT ON APN 321-060-23
(Vacation 03-01)
WHEREAS, the City Council of the City of Poway desires to vacate a waterline
easement in accordance with the procedures provided in Chapter 4, Part 3, Division 9
of the Streets and Highways Code of the State of California, commencing at Section
8330; and
WHEREAS, the City of Poway was granted a waterline easement on April 12,
2000, for a new waterline; and
WHEREAS, the existing waterline has been abandoned; and
WHEREAS, the existing waterline easement is no longer needed due to this
abandonment.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of
Poway as follows:
SECTION 1. The City of Poway hereby declares that the herein described
portion of the waterline easement on APN 321-060-23 is hereby vacated.
That easement described per Document No. 1724, recorded January 7, 1952, in
Book 4336, Page 485 of the Official Records in that portion of Lot 4 in Section 5,
Township 14 South, Range 1 West, San Bernardino Base and Meridian in the County
of San Diego, State of California, according to United States Government Survey
approved February 24, 1876, described as follows:
Beginning at a point in the West line of said Lot 4 distant thereon South 0048'00''
West 583.85 feet from the Northwest corner of said Lot 4, said point being also a
point in the Northerly boundary of that 40-foot road easement described in
Parcel 1 above, thence continuing South 0048'00'' West 23.93 feet to a point in
the center line of said 40-foot road easement; thence along said center line the
following courses and distances: South 55053'30'' East 24.16 feet to the
beginning of a tangent curve, concave Southwesterly having a radius of 200 feet;
thence Southeasterly along said curve through a central angle of 26003'20'' a
distance of 90.95 feet; thence South 29°50'10" East 150.63 feet to the beginning
of a tangent curve concave Northeasterly having a radius of 150 feet; thence
Southeasterly and Easterly along said curve through a central angle of 60055' a
distance of 159.48 feet; thence North 89°14'50'' East 63.41 feet to the beginning
of a tangent curve, concave Northerly having a radius of 333.87 feet; thence
Easterly along said curve through a central angle of 22036'20'' a distance of
131.73 feet to the beginning of a compound curve, concave Northwesterly

having a radius of 134.56 feet; thence Northeasterly along said curve through a
central angle of 24°18' a distance of 57.07 feet to the beginning of a compound
curve, concave Northwesterly having a radius of 120.00 feet; thence
Northeasterly and Northerly along said curve through a central angle of
46°56'50'' a distance of 98.33 feet; thence North 4~36'20'' West 133.76 feet to
the beginning of a tangent curve, concave Southeasterly having a radius of 70
feet; thence Northerly and Northeasterly along said curve, through a central
angle of 29°31" a distance of 36.06 feet more or less to the Southwesterly corner
of that parcel of land conveyed to Pauline A. Polen, by Deed recorded
September 7, 1955, in Book 5783, Page 296 of Official Records; thence leaving
said center line of said 40-foot road easement along the Westerly line of said
Polen's land North 5~52'20'' West 5.71 feet, to the Southeasterly corner of land
conveyed to Charlie B. Tamm, et ux, by Deed recorded February 24, 1956, in
Book 5989, Page 187 of Official Records; thence along the Southerly line thereof
North 84°65'30'' West 237.37 feet to an angle point in the land conveyed to
Charles B. Tamm, et ux, by Deed recorded February 18, 1952, in Book 4374,
Page 186 of Official Records; thence along the Southerly boundary of as follows:
South 71°08'50'' West 259.74 feet; and North 55°53'30'' West 83.52 feet more or
less to the point of Beginning.
SECTION 2. The City Clerk of the City of Poway is hereby directed to cause a
certified copy of this Resolution to be recorded in the Office of the Recorder of San
Diego County in accordance with Section 8336a of the Streets and Highways Code of
the State of California.
SECTION 3. That upon such recordation, the vacation is complete (Section
8336b).
PASSED, ADOPTED AND APPROVED by the City Council of the City of Poway
at a regular meeting this 7th day of January 2003.
