A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA,
APPROVING GENERAL PLAN AMENDMENT (GPA) 11 -01
ASSESSOR'S PARCEL NUMBERS 317 - 152 -10 and 11
WHEREAS, GPA 11 -01, submitted by Tim Thornbury and Dennis Jurgensen,
Applicants, is a request to amend the Land Use Element of the Poway General Plan
to change the land use designation of two adjoining parcels with a combined size of
1.66 acres (0.95 and 0.71), located at 12237 and 12249 Oak Knoll Road, from Residential
Single - Family -1 (RS -1) to Commercial Business (CB); and
WHEREAS, the City Council of the City of Poway recognizes that the need may
arise to amend the City's General Plan; and
WHEREAS, Section 65350, et seq., of the California Government Code describes
the procedures for amending General Plans; and
WHEREAS, on April 19, 2011, the City Council approved the initiation of
GPA 11 -01, and
WHEREAS, on May 17, 2011, the City Council held a duly advertised public
hearing to solicit comments from the public, both pro and con, relative to this application.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway as
follows:
Section 1: The City Council has considered the Environmental Initial Study (EIS) and
Negative Declaration (ND) for GPA 11 -01, and public comments received on the EIS
and ND. The subject EIS and ND documentation are fully incorporated herein by this
reference. The City Council finds, on the basis of the whole record before it, that there
is no substantial evidence the project will have a significant impact on the environment,
and that the ND reflects the independent judgment and analysis of the City. The City
Council hereby approves the ND.
Section 2: The City Council finds that the proposed General Plan Amendment, and the
corresponding Zone Change 11 -01, would bring the existing residential land use into
conformity with that of the existing commercial uses of the properties.
Section 3: The City Council hereby approves General Plan Amendment, GPA 11 -01,
an amendment to the Land Use Element of the Poway General Plan, re- designating
the land use of two adjoining parcels with a combined size of 1.66 acres, located at 12237
and 12249 Oak Knoll Road, from Residential Single - Family 1 (RS -1) to Commercial
Business (CB) as shown on Exhibit A.
