A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA,
APPROVING GENERAL PLAN AMENDMENT 10 -04
ASSESSOR'S PARCEL NUMBER 317 - 031 -28
WHEREAS, General Plan Amendment (GPA) 10 -04, submitted by Judith Wells,
Applicant, a request to amend the Land Use Element of the Poway General Plan to change
the land use designation on a 0.36 -acre parcel, located at 13624 Pomerado Road, from
Residential Apartment to Commercial Neighborhood; and
WHEREAS, the City Council of the City of Poway recognizes that the need may arise
to amend the City's General Plan; and
WHEREAS, Section 65350, et seq., of the California Government Code describes
the procedures for amending General Plans; and
WHEREAS, on November 9, 2010, the City Council approved the initiation of
GPA 10 -04, and
WHEREAS, on May 17, 2011, the City Council held a duly advertised public hearing
to solicit comments from the public, both pro and con, relative to this application.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway
as follows:
Section 1: The City Council has considered the Environmental Initial Study (EIS) and
Negative Declaration (ND) for GPA 10 -04, and public comments received on the EIS
and ND. The subject EIS and ND documentation are fully incorporated herein by this
reference. The City Council finds, on the basis of the whole record before it, that there
is no substantial evidence the project will have a significant impact on the environment.
Section 2: The City Council finds that the proposed General Plan Amendment, and the
corresponding Zone Change 11 -02, would bring the existing residential land use into
conformity with that of the existing commercial use of the property.
Section 3: The City Council hereby approves General Plan Amendment 10 -04, an
amendment to the Land Use Element of the Poway General Plan re- designating
the land use of a 0.36 -acre parcel, located at 13624 Pomerado Road, from Residential
Apartment (RA) to Commercial Neighborhood (CN) as shown on Exhibit A.
