A RESOLUTION OF THE CITY (IX3NCIL
OF THE CITY OF POWAY, CALIFORNIA,
APPRDVING THE SUPPL~/~AL REPORT PREPARED IN
CDNN~CTION WITH THE CREATION OF A
(I)b~W~JNITY FACILITIES DISTRICT
WHEREAS, the CITY OOUNCIL of the CITY OF POWAY, CALIFORNIA, (hereinafter
referred to as the "legislative body of the local Agency" ), has initiated pro-
ceedings to create a C~m.unity Facilities District pursuant to the terms and
provisions of the "Mallo-Roos C~,,t,unity Facilities Act of 1982", being C~apter
2.5, Part 1, Division 2, Title 5 of the Goverrm~ent (]ode of the State of
California. This C~,.unity Facilities District shall hereinafter be referred to
as
SOUTH P~WAY ~TY FACILITIES DISTRICT NO. 1
(hereinafter referred to as the "District" ); and,
WHerEAS, this legislative body has hereby received, pursuant to the provi-
sions of Section 53321.5 of the Government Code of the State of California,
from Don Owen & Associates, Inc., a supplemental report dated December 18, 1985,
(hereinafter, "R~po~ rt") providing m~re detailed information relating to the pro-
posed District, the proposed public facilities and estimate of cost.
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
S~CTION 1.
SECTION 2.
That the above recitals are all t~_e and correct.
That DON OWEN & ASSOCIATES, the appointed ENGIN~RR OF WORK,
bas hereby prepared and s,~atitted a "Report" presented this
night to this legislative body, said "Report" containing,
among other matters, information and data regarding a
description of the public facilities required to meet the
r. ccds of the District, data and information regarding the
estimate of the cost for providing said facilities, and data
relating to the rate or method of apportior~ent of the spe-
cial tax required to finance said public facilities.
SECTION 3. The preparation of the Report is hereby ratified. The
Report, as hereby suhnitted, is hereby approved and is made a
part of the record of the hearing regarding the creation of
the above-referenced District, and is ordered to be kept on
file with a record of these proccc~lings and open for public
inspection.
