A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA
ORDERING THE SUMMARY VACATION OF BLUE SAGE ROAD, CROSS FOX COURT,
MORNING AIR ROAD, COUNTRY DAY ROAD, TWISTED BRANCH ROAD,
WINDPIPER ROAD, AND HORIZON COURT, AND THE RESERVATION OF
CERTAIN PUBLIC SERVICE EASEMENTS FOR SEWER, WATER LINE, AND
DRAINAGE PURPOSES, AS DEDICATED BY COUNTY OF SAN DIEGO'S TRACT
NO. 4090R, MAP NO. 11360

WHEREAS, the City Council of the City of Poway desires to
summarily vacate certain streets, in accordance with the procedures
provided therefor in Chapter 2, Part 3, Division 9 of the Streets
and Highways Code of the State of California, commencing at
Section 8330, and
WHEREAS, the City Council of the City of Poway desires to
reserve public service easements within the proposed summary
vacation, in accordance with the procedures provided therefore
in Chapter 2, Part 3, Division 9 of the Streets and Highways
Code of the State of California, commencing at Section 8340.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the
City of Poway as follows:
This summary vacation is made under the provisions
of Chapter 4, Part 3, Division 9 of the Streets
and Highways Code of the State of California.
This reservation of public service easement is
made under the provisions of Chapter 5, Part 3,
Division 9 of the Streets and Highways Code of
the State of California.
3. The City Council hereby finds that:

The hereinbelow described streets known
as Blue Sage Road, Cross Fox Court,
Morning Air Road, Country Day Road,
Twisted Branch Road, Windpiper Road,
and Horizon Court are excess right-
of-way not required for public street
purposes and the streets lie within
property under one ownership (Sec.
8334 (a,b)).
The public service easements for sewer,
water line, and drainage purposes in,
upon, over, and across the hereinbelow
described streets known as Blue Sage
Road, Cross Fox Court, Morning Air Road,

Country Day Road, Twisted Branch Road,
Windpiper Road, and Horizon Court are
needed to construct, maintain, operate,
replace, remove, renew or enlarge such
public facilities (Sec. 8340(a)).
4. The City Council hereby declares that the following
streets are hereby vacated:

Those certain public streets known as
Blue Sage Road, Cross Fox Court, Morning
Air Road, Country Day Road, Twisted
Branch Road, Windpiper Road, and Horizon
Court, all within the County of San Diego,
Tract 4090R, recorded as Map No. 11360,
on October 24, 1985, in the Office of
the County Recorder of San Diego,
California.
5. The City Council hereby declares that the following
public service easements are hereby reserved:
Those certain public service easements
for sewer, water line, and drainage
purposes in, Upon, over, and across
those certain public streets known as
Blue Sage Road, Cross Fox Court,
Morning Air Road, Country Day Road,
Twisted Branch Road, Windpiper Road,
and Horizon Court, a~l within the
County of San Diego, Tract 4090R,
recorded as Map No. 11360, on October
24, 1985, in the Office of the County
Recorder of San Diego, California
(Sec. 8341(a)).
The City Clerk of the City of Poway is hereby directed
to cause a certified copy of this resolution to be
recorded in the office of the County Recorder of
San Diego County in accordance with the provisions
of Section 8336(a) of the Streets and Highways Code.
