A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA,
AMENDING THE APPEAL FEE CONTAINED
IN THE MASTER SCHEDULE OF FEES
WHEREAS, on May 4, 2010, the City Council adopted a Master Schedule of
Fees; and
WHEREAS, California Government Code Section 66016, et. Seq., establishes
procedures for the adoption of fees for services provided by local government; and
WHEREAS, the processing of an appeal will require staff time to investigate the
circumstances surrounding the application; and
WHEREAS, the established fee of $765 represents the reasonable costs of
providing the services; and
WHEREAS, a reduced appeal fee is appropriate for the Temporary Use Permits
and Comprehensive Sign Programs that were previously approved by City Council; and
WHEREAS, any additional costs incurred will be borne by the City's General
Fund.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway
as follows:
Section 1 : The City Council finds that this amendment to the Master Schedule of
Fees is exempt from the requirements of CEQA pursuant to CEQA Guidelines Section
15273 (a) (1) because it would establish a fee necessary to meet the City operating
expenses to process appeals of staff decisions to the City Council.
Section 2 : The City Council hereby modifies the fee in the Master Fee Schedule for
processing of an appeal to the City Council or project rehearing for Temporary Use
Permits and Comprehensive Sign Programs from $765 to $100.
PASSED, ADOPTED AND APPROVED by the City Council of the City of Poway
at a regular meeting this 21st day of June 2011.
