RESOLUTION NO. 10 -062
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA, ACCEPTING AN IRREVOCABLE OFFER
TO DEDICATE REAL PROPERTY, NOT PREVIOUSLY ACCEPTED BY THE SAN
DIEGO COUNTY FLOOD CONTROL DISTRICT, AT 14003 GASLIGHT COURT AND
A VACANT PARCEL AT GASLIGHT COURT, APN 314 -194 -34
WHEREAS, pursuant to Section 7050 of the Government Code, Four Flags West,
Inc.; a California corporation, made an Irrevocable Offer of Dedication to the San Diego
County Flood Control District for a drainage easement and right -of -way, recorded in the
official records of San Diego County, California, on March 21, 1977, book 1977 file /page
77- 102225 (available in the Poway City Clerk's Office) and,
WHEREAS, the San Diego County Flood Control District consented to the
recordation of the Irrevocable Offer of Dedication at that time; and
WHEREAS, when the City of Poway incorporated in 1980, the City succeeded to all
property rights held by the Flood Control District within the City's boundaries; and
WHEREAS, public convenience and necessity will be served if the irrevocable offer
of dedication is accepted by the City; and
WHEREAS, the City of Poway accepts the Irrevocable Offer to Dedicate Real
Property.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway,
pursuant to and in accordance with the authority contained in the Government Code
Section 7050, as follows:
Section 1: The City Council hereby finds and determines the foregoing recitals are true
and correct.
Section 2: All portions of the Irrevocable Offer to Dedicate Real Property, described in
original recording 1977- 102225, attached to City Council approved staff report dated
October 19, 2010, available in the City of Poway City Clerk's Office; is here by accepted.
Section 3: The City Clerk is hereby directed to cause a certified copy of this Resolution,
attested by the City Clerk under the seal of the City, to be recorded in the Office of the
County Recorder of San Diego County, California.
