A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA,
ACCEPTING THE DEDICATION IN FEE OF LOTS "D" AND "E"
OF MAP NO. 13542 FOR OPEN SPACE PURPOSES
WHEREAS, Shea Homes Limited Partnership, a California Limited Partnership,
offered the dedication, in fee, of Lots "D" and "E" (referred herein as Real Property) for
Open Space Purposes to the City of Poway on Map No. 13542, as recorded in the Official
Records of San Diego County, California, on March 17, 1998, as File No. 1998- 0143380; and
WHEREAS, the City of Poway rejected the offer of dedication of said Lots "0" and "E"
and consented to the recordation of the Final Map at that time; and
WHEREAS, of the pursuant to Section 66477.2 of the Subdivision Map Act, an offer
of dedication shall remain open and subject to future acceptance by the City; and
WHEREAS, public convenience and necessity will be served if Real Property is
accepted by the City; and
WHEREAS, the City of Poway rescinds the rejection of Lots "D" and "E" and accepts
said Real Property together with all the rights offered therein.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway,
pursuant to and in accordance with the authority contained in the Subdivision Map Act
66477.2, as follows:
Section 1: The City Council hereby finds and determines the foregoing recitals are true
and correct.
Section 2: All portions of the Real Property Dedicated in Fee, described as follows are
hereby accepted:
Lots 'D" and "E" of City of Poway Tract No. 88 -04R, Unit No. 2, Map No. 13542,
recorded in the office of the Recorder of San Diego County, State of California on
March 17, 1998, as File No. 1998 - 014338.
Section 3: The City Clerk is hereby directed to cause a certified copy of this Resolution,
attested by the City Clerk under the seal of the City, to be recorded in the Office of the County
Recorder of San Diego County, California.
