A RESOLUTION OF THE OITY COUNCIL OF THE OITY OF POWAY,
CALIFORNIA ORDERING THE SUMMARY VACATION OF A PORTION
OF A STREET AND UTILITY EASEMENT RESERVATION WITHIN
PARCEL 66 OF RECORD OF SURVEY NO. 3842
(VACATION VAC 86-04)
WHEREAS, the City Council of the City of Poway desJ. res
to summarily vacate a portion of a street and utility
easement: reservation in accordance with the procedures
provided therfor in Chapter 4, Part 3, Division 9 of the
Streets and Highways Code of the State of California,
commencing at Section 3880, and
WHEREEAS, a street and utility easement was reserved and
granted to the Poway MunicipaI Water District on November I3,
1975, recorded as File/Page No. 75-317953,
NOW, THEREFORE, BE IT RESOLVED, by the City Council of
the City of Poway as follows:
1. This summary vacation is made under the provisions
of Chapter 4, Part 3, Division 9, of the Streets and
Highways Oode of the State of CaIifornia.
2. The City Council hereby finds that:
The hereinbelow reserved street and utility
easement has been impassabie for pubiic
vehicuiar traveI for' a period of five
consecutive years and no public money was
expended for maintenance on the street during
such period (Sec:.
The hereinbelow reserved street and utility
easement has been superseded by reloc:ation and
there are no other public: facilities located
within the easement (Sec:. 8333(c:)).
The City Council hereby declares that the following
portion of the street and utiIity easement are
hereby vacated:
a. Parcel 1
Commenc:ing at the most Northerly corner of that
certain parcel of land delineated and designated
as" Parcel 67 "on Record of Survey Map No.
3842, being a point on the arc of a curve,
concave Northwesterly, having a radius of 400.00
feet, in the center Iine of that certain 50.00

Road" on said Record of Survey Map No. 3842, a
radial line to said point bears South 50 19'22"
