A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
DECLARING THE 7(K) EXEMPTION
OF THE FAIR LABOR STANDARDS ACT
AS APPLICABLE TO CERTAIN SAFETY SERVICES PERSONNEL
WHEREAS, the 7(K) exemption of the FLSA provides that fire
service personnel may have an alternative workweek than 40 hours if a
City so declares; and
WHEREAS, the 7(K) exemption provides that overtime at time and
one-half shall be paid for all hours worked in excess of a 53-hour
workweek.
NOW, THEREFORE, the City Council of the City 'of Poway does hereby
resolve and order as follows:
Section 1. The City of Poway elects to declare the 7(K)
exemption as it pertains to Safety Service personnel who work twenty-
four hour shifts.
Section 2. The work period for twenty-four hours shift public
safety employees shall be a regularly recurring twenty-four day period,
commencing at 12:00 midnight on April 14, 1986. Schedules within the
work period shall be as determined by City staff and current Memoranda
of Understanding.
