A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY
ORDERING THE SUMMARY VACATION OF PUBLIC SERVICE EASEMENTS
WITHIN THE SOUTH HALF OF THE SOUTHEAST QUARTER OF SECTION 2,
AND THE NORTHEAST QUARTER OF THE NORTHEAST QUARTER OF SECTION
II, TOWNSHIP 14 SOUTH, RANGE 2 WEST, SAN BERNARDINO MERIDIAN
IN THE CITY OF POWAY, STATE OF CALIFORNIA, ALL WITHIN
CITY OF POWAY TRACT NO. 4191-R
(VACATION VAC 86-05)
WHERAS, the City Council of the City of Poway desires to
summarily vacate public service easements in accordance with the
procedures provided thereof in Chapter 4, Part 3, Division 9 of
the Streets and Highways Code of the State of California,
commencing at Section 8330, and
WHEREAS, by separate instruments, a storm drainage easement
and a water line easement in that portion of the Southeast Quarter
of Sec. 2, and that portion of the Northeast Quarter of Sec. 11,
T14S, R2W, SBM were granted to the City of Poway per F/P No.
84-341961, recorded 9/7/84, and F/P No. 84-341960, recorded
9/7/84 respectively.
WHEREAS, by separate instrument, a water easement in
portions of Section 2, 11, and 12,.T14S, R2W, SBM was granted
to the Poway Municipal Water District per Document No. 80-392581,
recorded 11/21/80.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of
the City of Poway as follows:
This summary vacation is made under the
provisions of Chapter 4; Part 3, Division 9
of the Streets and Highways Code of the
State of California.
2. The City Council hereby finds that:
The hereinbelow described public
service easements for storm drainage
and water line purposes has been
superseded by relocation and there
are no other public facilities
located within the easements
(Section 8333(c)). ~

No. 4191-1R.

The alternate locations of water line
easements are within the street right-
of-way in City of Poway Tract No.
4191-1R, said street right-of-way is
offered for dedication in said Tract
4191-1R.
The City Council hereby declares that the
following public service easements are hereby
vacated conditioned upon the City Council
approval and recordation of City of Poway
Tract No. 4191-1R, and acceptance of street
right-of-way in said Tract No. 4191-1R:

That certain storm drainage easement
granted to the City of Poway in that
portion of the Southeast Quarter of
Section 2, T14S, R2W, SBM per F/P
No. 84-341961, recorded 9/7/84 in the
office of the Recorder of San Diego
County, California.
That certain water lines and appurtenances
easement granted to the City of Poway in
that portion of the Southeast Quarter of
Section 2, T14S, R2W, SBM per F/P No.
84-341960, recorded 9/7/84 in the
office of the Recorder of San Diego
County, California.
That portion of that certain water line
easement granted to the Poway Municipal
Water District in the Southeast Quarter
of Section 2, T14S, R2W, SBM per Document
No. 80-392581, recorded 11/21/80, only
within City of Poway Tract No. 4191-1R.
The City Clerk of the City of Poway is hereby
directed to cause a certified copy of this
resolution to be recorded in the office of
the County Recorder of San Diego in accordance
with the provisions of Section 8336 of the
Streets and Highways Code.
