Res 86-043RESOLUTION NO. 86-043 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY INITIATING PROCEEDINGS TO FORM AN ASSESSMENT DISTRICT FOR THE INSTALLATION, OPERATION, AND MAINTENANCE OF PUBLIC LIGHTING FACILITIES IN THE CITY OF POWAY WHEREAS, the City of Poway desires to form an assessment district for the purpose of installing, operating, and maintaining public lighting facilities in the City of Poway; and WHEREAS, Chapters 1-6, (commencing with Section 22500), Part 2, Division 15, of the Streets and Highways Code authorizes the formation of an assessment district which can levy a benefit assessment for the purpose of financing the installation, operation, and maintenance of public lighting facilities; and WHEREAS, Section 22585, Chapter 2, Part 2, Division 15, of the Streets and Highways Code requires that the proceedings for the formation of an assessment district under that part be initiated by resolution: NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway, California that the City proposes to form an assessment district pursuant to Chapters 1-6, (commencing with 22500), Part 2 Division 15, of the Streets and Highways Code for the purpose of installing, operating, and maintaining public lighting facilities in the City of Poway; and BE IT FURTHER RESOLVED by the City Council of the City of Poway, California that the proposed assessment district shall contain, generally, all that territory within the boundaries of the City of Poway on July 1, 1986; and BE IT FURTHER RESOLVED by the City Council of the City of Poway, California that the proposed assessment district formed for the purpose of installing, operating, and maintaining the above described public lighting facilities shall be known as the Poway City Lighting District; and BE IT FURTHER RESOLVED AND ORDERED by the City Council of the City of Poway, California, that gas, water, or electric utility right-of-way or electric line right-of-way in the proposed district that is used to hold facilities that transport the utilities' product, and open space lots will not be subject to an annual assessment, however, the real property in the proposed District owned by a public utility that benefits to the same extent as taxable property, shall be assessed to the same extent and in the same manner as the taxable parcels in the proposed District; and BE IT FURTHER RESOLVED AND FURTHER ORDERED by the City Council of the City of Poway, California that the Director of the Department of Public Services, acting as the Engineer of the proposed assessment Resolution No. 86-43 Page 2 district shall prepare an "Engineer's Report" in accordance with Article 4, (commencing with Section 22565), Chapter 1, Part 2, Division 15, of the Streets and Highways Code, and file said report with the City Clerk of the City of Poway when completed.
