WHEREAS, the public interest and convenience requires the main-
tenance, service and operation of the public lmnd.~caping, soundwalls,
and recreational trails within said territory.
NOW TMEREFCRE, the City Council of the City of Poway does
hereby resolve as follows:
1. The foregoing recitals are true and correct and the City
Coancil so finds and determines.

FOR POWAY
LANDSCAPE MAINTENANCE ASSESSMENT DISTRICT NO. 86-1
FOR 1986-87 FISCAL YEAR
PURPOSE
The purpose of this report is to set forth findings and enginering
analysis for the Poway Landscape Maintenance Assessment District
No. 83-1 for 1986-87 fiscal year. The Assessment District was
formed June 12, 1985 as a means of financing the maintenance of
landscape improvements installed in conjunction with new sub-
divisions in Poway, the boundary being as shown in Exhibit A.
FINDINGS
The Landscaping and Lighting Act of 1972 permits the establishment
of assessment districts by cities for the purpose of providing for
the maintenance of certain public improvements which includes the
facilities existing within the subject assessment district. The
1972 Act requires that maintenance assessments be levied according
to benefit rather than according to estimated value. Section 22573
provides that:
"The net amount to be assessed upon lands within an
assessment district may be apportioned by any formula
or method which fairly distributes the net amount
among all assessable lots or parcels in proportion to
the estimated benefit to be received by each such lot
or parcel from the improvements."
Based upon the foregoing, it is proposed the City of Poway generate
the necessary revenue required to maintain the aforementioned land-
scaping improvements with Landscape Maintenance Assessment District
No. 86-1 for the 1986-87 fiscal year using the method provided for
in the Landscape and Lighting Act of 1972.
ENGINEERING ANALYSIS
Boundary
The boundary of the proposed assessment district is as shown in
Exhibit A with Hirsch Ranch Tracts 4090R, 4091R, 4092R and 4093R
being the present full extent of the district with 415 lots.
The district boundaries are included in the district, excepting
from the assessment of said costs and expenses within the area
described, the area of all public streets, public avenues, public
lanes, public roads, public drives, public courts, public alleys,
all easements and rights of way, all public parks, greenbelts a~d
parkways, and all public school property being used for public
school purposes.
NAME
The District is entitled the "Poway Landscape Maintenance Assessment
District No. 86-1."
FACILITIES
The facilities to be maintained are defined as the landscaping and
soundwalls within the right of way and adjacent to Espola Road; the
recreational trails and sidewalks, and greenbelts within the District
boundaries.
EXISTING CONDITIONS OF LANDSCAPE MAINTENANCE WITH DEVELOPED
SUBDIVISIONS OF DISTRICT
A general assessment of the present level and quality of landscape
maintenance within subdivisions of the District having improved
landscape development within public right of way has been recently
conducted. A small percentage of the required improvements is in
place at this time. Each of the respective subdivisions will again be
inventoried and evaluated to insure compliance with requested improve-
ments to landscape maintenance prior to City acceptance of said deve-
loped areas into the Assessment District. Landscape maintenance and
performance standards and specifications are currently being developed
to assure a level of consistency and quality to landscape care of
assessment district properties upon City acceptance.
BENEFIT ANALYSIS
The District is made up of four subdivisions, Tracts 4090R, 4091R,
4092R, and 4093R, for a total of 415 residential lots. The assess-
ments will be calculated on a per lot basis by dividing the total
budget by 415.

ASSESSMENT
It is determined that all residential lots benefit equally.
Accordingly, the assessment for each lot is:
