Res 86-051RESOLUTION NO. 86-051 A RESOLUTION OF APPLICATION BY THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA REQUESTING THE LOCAL AGENCY FORMATION COMMISSION TO TAKE PROCEEDINGS FOR THE "BUREAU OF LAND MANAGEMENT TERRITORY REORGANIZATION." RESOLVED, by the City Council of the City of Poway, that WHEREAS, the City of Poway desires to initiate proceedings pur- suant to the Cortese/Knox Local Government Reorganization Act of 1985, Division 3, commencing with Section 56000 of the California Government Code, for the proposed Bureau of Land Management (BLM) Territory Reorganization; and WHEREAS, the proposed reorganization involves the annexation of approximately 1,325 acres of unincorporated territory to the City of Poway, and detachment of an approximate 405 acre portion of the same territory from the Ramona Municipal Water District; and WHEREAS, the territory involved in the subject reorganization proposal is uninhabited, and a description of the boundaries of the territory is set forth in Exhibit A and a depiction of the terri- tory is shown on Exhibit B attached hereto and by this reference incorporated herein; and WHEREAS, this proposal is consistent with the Sphere of Influence of the City of Poway, as approved by the San Diego Local Agency Formation Commission on August 5, 1985; and WHEREAS, the Bureau of Land Management, current owner of the territory in question, has authorized the City of Poway to be the "lead agency" for the reorganization proceedings; and WHEREAS, the reasons for the proposed reorganization are to provide for a change of organization which would result in the City of Poway's complete jurisdiction over 1,877 acres of BLM land which the City presently leases from the BLM, and to facilitate the pro- visions of the lease agreement between the City of Poway and Bureau of Land Management; and WHEREAS, pursuant to Section 56653 of the California Government Code, a plan for providing services is contained in Exhibit C attached hereto and by this reference incorporated herein; and WHEREAS, the City Council finds that the proposed reorganization will not result in any significant adverse environmental impacts and hereby issues a Negative Declaration. Resolution No. 86-051 Page 2 NOW THEREFORE, BE IT RESOLVED, that this Resolution of Application is hereby adopted and approved by the City Council of the City of Poway, and the Local Agency Formation Commission of San Diego County is hereby requested to take proceedings for the reorganization of territory as described in Exhibit A and shown on Exhibit B in the manner provided by the Cortese/Knox Local Government Reorganization Act of 1985. The City Clerk of the City of Poway shall file a certified copy of this resolution with the executive offices of LAFCO, as required by Section 56802 of the Government code. EXl-.tll5 IT' E5 A PLAN FOR SERVICES FOR THE PROPOSED BUREAU OF LAND MANAGEMENT TERRITORY REORGANIZATION (CITY OF POWAY) PURSUANT TO SECTION 56653 OF THE CALIFORNIA GOVERNMENT CODE The proposed reorganization, which involves 1,325 acres of public land proposed to be developed with a system of riding and hiking trails, will require the following muni- cipal services: ae Safety Services - Police Protection - Fire suppression and protection - Emergency Medical Services b. Maintenance Services for trail system The level and range of the above mentioned services will be that necessary to provide an on-going trail maintenance program and to maintain a high level of safety services. The City of Poway along with the San Diego County Sheriff's Department, the California Division of Foresty, and the California Conservation Corp., will be responsible for the provision of these services on the date the pro- posed reorganization becomes effective. The reorganization area will not be provided any other services than those mentioned above. It is not proposed, for instance, that any utility lines will be extended to the proposal area. The improvements to the trail system will be limited to trail construction, fencing, and iden- tification. No structures or other facilities will be necessary. The safety and maintenance services described above will be financed by the City of Poway through its budgetary process. Funding from other agencies or sources will not be required to maintain these services for the reorganiza- tion area. EXHIBIT C
