~EAS, The city Council of the City of Pow-ay on May 13, 1986, adopted a
resolution initiating proc-~lings to form an assess~_nt district, pursn~nt to
Chaunters 1-6 (c~L.Lencing with Section 22500), Part 2, Division 15, of the
Streets and Highways Code for the purpose of installing, operating and main-
taining public lighting facilities in the City of Poway; and
~F_AS, it was resolved that the proposed assessment district sb~all con-
tain, generally, all that territory within the boundaries of the City of Poway
on July 1, 1986; and
~REAS, it was resolved that the proposed assessment district shall be
known as the Poway City Lighting District; and
~{FAS, it was resolved and ordered that gas, water, or electric utility
right-of-way or electric line right-of-way in the proposed district that is used
to hold facilities that transport the utilities' product and open space will not
be subject to an anm,~l assessment; however, the real property in the proposed
district owned by a railroad or public utility that benefits to the same extent
as taxable property, shall be assessed to the same extent and in the same manner
as the ta~hle parcels in the proposed district; and
~5~EAS, it was resolved and ordered that the Director of Public Services,
acting as the Engineer of the proposed Poway City Lighting District, prepare an
Engir~r's Report in accordance with Article 4 (cuL,Lencing with 22565), Chaunter
1, part 2, Division 15, of the Streets and Highways Code and file said report
with the City Clerk of the city of Poway when cu~pleted; and
~AS, said Engineer's Report was c~L~leted, filed with the City Clerk,
$1}~%itted to the City Council and was approved by said Council.
NOW, THEREFfRE, BE IT R~-~DLVfD, by the City Council of the city of Poway,
California, that the City declares its intention to order the formation of an
assessment district pursn~nt to Chapters 1-6 (c~.~en~ing with Section 22500),
part 2, Division 15, of the Streets and Highways Code, to levy and collect
assessments for the purpose of inst~]ling, operating and maintaining public
lighting facilities in the City of Pcway; and
BE IT FJRTHER R~OLVfD by the City Council of the City of Pow-ay, California,
that the City Council does not desire to assess any government agency owning
real property within the district; such agencies include the Poway Unified
School District, County of San Diego, State of California, and the City of

California that notice is hereby given that on the 17th day of Jlme, 1986, at
the City of Pc~zay C~L,L~nity Center, 13094 Bowron Road, Poway, California, 92064,
a public he_raring will be held to ascertain the desirability of forming an
assessment district for the purpose of installing, operating and main~{ning
public strut lighting facilities in the City of Poway; and
BE IT FORTHER RESOLVED ABD FURT~I~R C~DERt~ by the city Council of the City
of Pow-ay, California, that the City Clerk shall give notice of the bearing by
causing the Resolution of Intention to be published purs,~ant to Section 6061 of
the Goverranent Code and mailed, postage prepaid, first class and deposited in
the united States mil to all persons owning real property within the proposed
lighting district, whose names and addresses appe~__r on the last ec~l ized County
Assessment Roll or the State Board of ~l ization Assessment Roll, as the case
maybe.
Publication of Notice of B~ring shall be c~fpleted, and mailed Notice of
the H~m__ring shall be deposited, at least ten (10) days prior to the date of
b~ring specified herein.
