~HEREAS, existing law provides that counties have the authority to site
detention facilities within city boumdaries despite formal opposition from the
affected city goverrm~_nt; and
~HEREAS, the inappropriate siting of county detention facilities could have
serious social and fiscal impacts upon the public welfare, safety and economic
viability of these c~,,,,onities; and
~{fREAS, s~ae county detention facilities are proposed for city redevelop-
ment project areas financed through tax incr~nent funds, and the resulting pro-
perty devaluation may affect the city's ability to finance necessary public
improvements au~t revitalization efforts; and
~f~REAS, SB 2543 (Presley) would provide the state bond funding for the
construction of new county jail facilities; and
~{EAS, Ass~nblyman Larry Stirling has sponsored amendments to SB 2543 to
require city council approval in the Counties of San Diego and Los Angeles for
all county jail facilities funded through the statewide jail construction boD~g;
W~RREAS; these amendments aa~ress the critical issue of local control over
vital matters affecting the social and econcmic well-being of a c~L,,onity, such
as the siting of a county detention facility.
NOW, TH~EFf~E BE IT RESOLVfD that the city Council of the city of Poway
does hereby support the proposed amendments to S~ 2543 to provide for local
control over the siting of county detention facilities, and we do hereby urge
the State Legislature to approve these amendments.
