Res 86-072RESOLUTION NO. 86-072 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA, ESTABLISHING CRITERIA FOR THE WAIVER OF THE REQUIREMENT FOR UNDERGROUNDING OF UTILITIES AND RESCINDING RESOLUTION NO. 86-026 WHEREAS, the City Council wishes to establish equitable stan- dards for the waiver of the requirement to underground utilities. NOW THEREFORE, BE IT RESOLVED that the Poway City Council adopts the following: SECTION I: Requirements for Waiver of Undergrounding of Utilities City Council may waive the undergrounding of utilities when the following criteria are met: ao Be Ce The development is in an RR-A zoned area not served by City water, and can be further subdivided if City water is extended in the future to serve that area; or the proposed project shall be in an area of predominantly overhead ser- vice, and new poles will not be added as a result of the service, unless the closest service point is over 1,000 feet away; or the new building site is the last lot to be developed in an area where all surrounding properties are served by overhead lines; and The proposed area for waiver on a project shall not be along a Circulation Element road; and The applicant shall record a deed covenant agreeing not to oppose an undergrounding district and to pay a pro rata share of future undergrounding costs. Upgrading of existing overhead facilities and additions of cable or lines to existing overhead utility poles by the utility shall be permitted overhead. These waiver provisions shall not apply to building ser- vices. All new buildings shall have underground services. In the case of a request for a waiver of undergrounding require- ments for Minor Development Reviews of single family homes, the Director of Planning Services may grant such a waiver subject to the criteria described above. SECTION II: Resolution 86-026 is hereby rescinded. Resolution No. 86-072 Page 2 APPROVED and ADOPTED by the City Council of the City of Poway, State of California, this 24th day of June, 1986.
