Res 86-106RESOLUTICN NO. 86-106 A RESOLUTION OF THE CITY C(~3NCIL CF THE CITY CF POWAY, CALIFORNIA, APPROVING THE APPLICATICN FOR GRANT FJNDS SERVING PROGRAM OF THE C.AT.TFOIq~IIA PARK AND R~CREATIONAL FACILITIES ACT OF 1984 FOR P0~AY C(/4~3NITY PARK WTST LANDSCAPING P~ WHEREAS, the people of the State of California have enacted the California Park and 9~creatioaal Facilities ~-t of 1984, which provides funds to the State of California and its political subdivisions for developing facilities for public recreational purposes; and WHEREAS, the State Department of Parks and Recreation ba~ bccn delegated the responsibility for the administration of the program within the state, setting up necessary procedures governing application by local agencies under the program; and ~g_~S, said procedures es~_~hlished by the State Department of Parks and Recreatioa require the applicant to certify by resolution the approval of appli- cations before submission of said applications to the state; and W~R.~F_AS, said applications contain assurances that the applicant ~m,~t cc~ply with; and ~2~AS, the applicant agency will enter into an agr~. t with the State of California for develo~nent rehabilitation or restoration of the project. NC~, THEREFORE, BE IT RESOLVED, that the City Council of the City of Pow~y, California hereby: 1. Approves the filing of an application for 1984 state grant assistance for the Poway CuLmiunity Park West Landscaping Project; and 2. Certifies that said agency understands the assurances and certification in the application; and 3. Certifies that said agency has or will have have sufficient funds to operate and maintain the project, and if the project is selected for state grant funding; and 4. Certifies that said organization will provide construction plans and specifications to the state within one y~r of the appropriation of funds under this program and will c~';Llence work immediately after state approval; and R~olution ~. 86-106 Page2 5e Appoints the City Manager as agent of the City of Pc~ay to conduct all negotiations, e~ecute and sub~it all documents including but not limited to applications, agreements, amendments, payment requests, and so on which may be necessary for the c~%~letion of the afor~entioned projects ( s ); and Appoints Steve Eckis, City Attorney, as legal counsel for said agency with authorization to sign the certification on page 1 of application.
